Response To USCIS' Request For Evidence Was Received

On May 3, 2017, we received your response to our Request for Evidence for your Form I-129F, Petition for Fiance(E)

Whats the hold up?  All that was needed was our passport pics and letter of intent to marry from Grace.. This should of been an easy OK, Approved... next step!

Your thoughts? Any guesses when?  Grace is getting nervous something is up because we both agree this should be an easy one to get through and pass?

@Queen30 I was looking at a copy of an old version of packet 3 (from 2015). Does your recent copy still request a bank letter and job letter for the affidavit of support?

Hey yes it does . Sorry for the late reply

Hello @TerrenceR, thank you for the headsup. I was able to schedule my interview online just TODAY due to the delay in my medical. I was instructed to take the psych exam and evaluation due to annulled status (I'm the petitioner). I thought i won't take this exam anymore coz the one declared mentally incapacitated in my annulment decree was my former husband and not me. Well, i guess it's really up to the assigned doctor reviewing the papers. Though i have no qualms on this coz i was advised by the staff that this is just a protocol that i need to take. Nothing to worry about. :)

Then as im about to schedule, only to my surprise that the earliest available interview date is JULY 6, 2017!!! 😭😭😭 We were targeting late May or early June!!! So, i have no choice but to get that July 6. I have a confirmed appointment already.

My question: Do i have a chance to move the date earlier like mid-June? May i request the embassy customer service to help me find an earlier date if there have been 'cancelled' slots made by other applicants ahead of me?

Hope to get an advice.

Aloha! 😊

Not bad. Sorry for the late response as I've been traveling. I would check the appointment page daily to see if any spots open up. For example, I had a slot on May 17th, but had to cancel due to the sputum test. I don't think that the embassy customer service is the best bet for that but if you don't have any luck using their online scheduling system then I would definitely call. Doesn't hurt to try! As for me, I'm not looking to do medical for a couple more months. :(

Anyways, best of luck!

hi! our status is still in transit. it is almost a week now.

all the best for the interview! :D

Thanks for the wishes, I actually had to cancel due to medical. Hopefully that will only take 60 days (after the sputum collection) and we will be free to move forward late July/early August. What a headache! :D

Really sucks that she has to do so much traveling between Cebu and Manila. Unfortunately, it's not cheap for all the flights/hotels. I hope your case is moving forward more smoothly!

Hope it works out for you! My fiance is from Occidental Mindoro, so she did tons of traveling too. Luckily, she has family in Manila she can stay with.

Thanks, it will work out, just not within the time we were hoping. If only she had family there, I would be grateful.

I'm just hoping she doesn't have to do the six month treatment because I've heard you need to go to SLEC daily for the medication. I have NO idea what I will do if she needs to do that.

I've heard that as well with the 6 month medication. I was sweating the medical so badly. Has your fiance had a history of tb before? Or maybe it was just scarring of some kind? You hear all kinds of stories about people having to do the sputum that have no history.

No history whatsoever of tb. I'm guessing it was some kind of scarring but I don't think she has a completely clear picture as to why exactly they need to conduct further testing. I wasn't sweating the medical because I thought the chances were extremely low.

It sucks sometimes as I haven't been able to spend much time with them because of work. Hopefully, it will be done soon.

Well, you know it's a normal occurrence it takes them at least 2-3 weeks to process the response to an RFE. Plus the electronic system doesn't always updates nowadays, so you might have to wait for the NOA2 hardcopy in the mailbox, which adds maybe another week minimum.

Hang in there, you two! You are almost there :)

Put the date that the first day you entered for the first time in the USA.

if you don't remember the exact date then just give a close estimate date.

Roger, I FedExed my response overnight and it shows on my tracker that it  was received April 26th. Nothing back yet, my hand shakes when i go to open the mailbox, only to see Costco ads, and lawn services!! Anyway I will let you know if anything changes, I don't suppose calling them would do any good?

Read it carefully,

IF YOU HAVE A 2 YEAR GREEN CARD YOU FILE FOR REMOVAL OF CONDITIONS (ROC) 90 days prior to your green card expires.

"A conditional permanent resident receives a green card valid for 2 years. In order to remain a permanent resident, a conditional permanent resident must file a petition to remove the condition during the 90 days before the card expires. The conditional card cannot be renewed. The conditions must be removed or you will lose your permanent resident status."

"Any alien granted permanent resident status on a conditional basis (e.g., a spouse of a U.S. citizen; an immigrant investor), who is required to petition for the removal of the set conditions before the second anniversary of the approval of his or her conditional status."

Conditional status starts when you first obtain lawful status in the US,
for CR-1's that is the day you enter the US
for K-1's that is the date on your green card, (when it was approved/ issued) (not when you entered the US,

for CR-1 if you enter the US AFTER your 2nd wedding annivasary then the officer at the POE should change you to IR1, (the embassy can also change it if your interivew is after the 2nd annivasary.

Yes you have to file ROC (if required), in order to apply for US citizenship.
some think they can "save money by not filing for ROC after 2 years instead just apply for US citizenship after 3 years.
well they are wrong.

"An application for naturalization may not be approved if there is a pending petition for removal of conditions. If an applicant’s petition to remove conditions is pending at the time of filing or is filed prior to the interview, USCIS will adjudicate the petition to remove conditions prior to or concurrently with the adjudication of the naturalization application"
