Getting Ready to Submit I-130 and I-485 [merged threads]

Was wondering if anyone has some advice. I can't decide whether to hire an attorney to review and file 130, 485. I keep reading horror stories of them being rejected for one reason or another.

I'm most concerned about proof of a bona fide marriage and getting married on a B2 visa (we waited about 75 days after he arrived in the US).

There is minimal to include as my husband and I were just married on the 19th of Nov. Can't add him to my health insurance yet as he has no SS no. Car and house are in my name.

So far, we have a marriage cert, wedding cards, pictures, 2 affidavits, credit card statements showing him as an authorized user, copies of wedding checks (gifts), beneficiairy to a retirement account.

Anwyay, just so nervous about it.

Also, does anyone know.... If it was rejected, does it get rejected now or after an interview?

Thanks for any advice/suggestions!!!

It's unlikely that your application gets flat out denied without giving you an opportunity to provide more evidence (if they find something is missing). Make sure you fill in all the paperwork correctly, attach all the required documentation and as much evidence of bona fide marriage as possible (sounds like you have quite a bit already, for such a young marriage). Make sure you pay the correct fee.

Theoretically, you could be denied at any stage, but it is unlikely.

If it isn't difficult, it isn't worth it.

 

K1 process

9/24/15: I129f sent

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

Thank you. Are there any outright thing they can immediately deny you for? Like getting married too quickly? Not enough evidence of "real" marriage?

Losing sleep over this!

Nothing like you imagine. Chill. Using the wrong forms, for some reason not being eligible (eg. you not being a USC, polygamy), submitting the wrong fee and other formal requirements are usually the only ones that will lead to an "immediate" denial.

Is it a stupid idea to submit photos of wedding cards and wedding gifts (checks)??

No.

If it isn't difficult, it isn't worth it.

You won't be denied.

They will tell you if they need more info. The only reason for a flat out denial is false documents or lying on a form.

You can do the same thing an attorney can do and you can do it quicker.

Your mind will try to play tricks on you, but dont let it. Just follow the directions on this website and you wont go wrong.

Pray about it once and release it.

Consider creating Wills, healthcare powers of attorney, and similar documents. These make excellent evidence, and they're even more important to have in "life."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Ok, thank you. Guess I'll hold off on a lawyer for when we may really need one (hopefully never lol)

Lawyer is a waste of money and time, they make mistakes too.

You can do this by yourself, reserve a weekend to fill out the forms, and gather what evidence you do have.

FILED  AOS FROM AN EXPIRED VISITORS VISA:

 

Sent: 9/12/16: I-130 + I-485 + I-765 (USPS)

Delivered: Sept. 15th 2016 to Chicago Lock Box

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

Had a question regarding submitting proof of bona fide marriage.

I spoke with an attorney and was told he tells his clients to wait to the interview to submit proof. Obviously, a marriage certificate is a must, but suggests to hold off on everything else until the interview.

I'm feel confused because on the USCIS website, it says to submit proof.

Any thoughts?

Wait until the interview or submit photos etc, now??

Send proof for the interview.

This website has a complete check list for what to send. Send it exactly as its listed and you will be just fine.

Lawyers have an angle. They will tell you whatever will make you need them.
