Hi all

I am filling out the AOS for my husband and I am concerned about my last name.

Little background-with my first marriage, I had kids and remained with my ex-husband´s last name. This has been my legal last name with all my documents till now whenI will officially change to my new husband´s last name. My question is do I fill out these applications with my maiden name as I did with the original k-1 filing application? or with my legal last name?

this has me a little concerned.

please help.

Fill out the documents with your new married name if you are changing it, since this will be what will be on your ead and eventually your green card

Oh my bad..it's late :P

This is for your husband? You are the usc?

Even so, I would still use your new name since you are now married and your legal name is changing. The changing of names is a process so any ID you currently have is valid together with your marriage license as an ID... I Suggest you just start changing it ;)

Hi --No, the paperwork i'm filling out is for my husband and not for me but I need to add my last name since i'm the petitioner in most of the applications.

this is where I was confused.

I am going to start changing my name soon.

Well he is the petitioner in AOS... on all the forms except the affidavit, but yes there you will have to put it ofc. And it's fine to put your new name also for the usc. You are providing the marriage license.
