Hello everyone,

I have just a couple of questions on the forms I-864 and I-864A before they are final.

Wife's I-864

  • Part 6 - My wife (principal sponsor) is currently employed in the UK and of course she will leave her job to move to the US with me. In short, her income in the UK will not be used to meet affidavit requirements as it will terminate soon (and that's why we had her dad filling a I-864 as a co-sponsor). Would she be classified as unemployed for this purpose? Could we write her employer's name in the UK and write zero as income? or should we still write her annual income in the UK?

I-864A contract between my mother in law (household member) and father in law (co-sponsor)

  • My parents in law file jointly. My dad in law (joint sponsor) makes enough to go above the poverty threshold. Does my mother in law (household member) need an I-864A just because they file jointly?
  • Part 3 - my mother in law is disable and thus receives social security benefits. Could we say that she is unemployed and then write her social security benefits as annual income (and as reported on joint tax returns)?
