Hi there,

Let me start out by saying that this was a very foolish thing to do given the fact that you knew very well the tests where coming, especially seeing as you say this was the first time you tried it. With that being said and done, I can tell you that there will be a urine test and a blood test. The one you have to worry about is the urine test, as traces of THC-COOH can be found there far longer than in blood testing.

The Break Down

The fact that you used it for the 1st time is in your favour, you are still a nitwit for doing it but at least it was just the once! What you choose to tell the doctor is entirely up to you and I will not give you any advice there. All I will give you is cold hard facts regarding timelines and consumption. The timelines I will be stating will be the absolute maximums for detection so as to give you a clear picture, you are welcome to go online and fact check yourself and I encourage this. What you decide to tell the official is entirely up to you in the end.

Urine Testing

Seeing as the only info to go on is that you stated you smoked it twice approximately 7 days ago we will have to go on that. We will assume you are of average build, in your mid to late 20's, and that it was an average sized joint. That being said, it will remain detectable for up to a maximum of 30 days. In other words I am saying you will get away with it based on the timeline you have given of 5 weeks until testing (35 days).

Blood Testing

Traces of Cannabis use can be found up to 10 days later (Absolute Max). You are again safe here based on the timeline of 5 weeks (35 days).

Advice and Words of Wisdom

You will likely get past the test but again let me state, what you did was downright idiotic and I personally cannot believe anyone would jeopardize all their hard work trying to get a US Visa over something so stupid as recreational marijuana use.

Tell the truth and most likely you'll be fine. Like others said, you acted very irresponsibly to have done this. Regarding legality: it is NOT illegal in the US to have used marijuana abroad (regardless of your citizenship). It is, however, in discretion of the doctor and IO to decide if you're admissible or not based on such actions. If you get arrested (fined, etc) abroad, whether it's for drug use or anything else, that becomes an issue with USCIS. Using marijuana in the US is illegal by the federal law (so you can't use it even in a State that allows it).

So if you did not get arrested or fined you are okay as far as Criminal Justice is concerned (a USC acting the same way abroad would not face any consequences in the US either). As far as USCIS is concerned that's another matter entirely and has nothing to do with legality of your act.

I would say you should say yes. Even though it's true that some part of the states had legalized it for recreational use... you should have try it when you visit Colorado or Washington.
