I am a US born citizen. My wife, currently on a permanent resident status, will file for naturalization in a year. Her mother has a five year B1/2 tourist visa. She has visited us on 4 previous trips.

Trip 1- Lasted 2 weeks

Trip 2- Lasted 5 months

Trip 3- Lasted 4 months

Trip 4- Lasted 3 months

Her mother plans to visit another time before her visa expires for a few months. Once my wife becomes a US citizen, which will be after her mother's tourist visa expires, we plan to file the I 130 to bring her mother over permanently.

Based upon the amount of time her mother has visited us over the past few years, does anyone see an issue when we file the I 130. My concern is she may have spent too much time here as a tourist. She has never overstayed her visa on any of her visits.

Length of previous legal visits on a B2 is irrelevant to Immigrant visas.

Once here permanently, she has to make the US her home and spend the majority of her time here in the US.
