Okay... my father in law is 75 and now living with us. We need to get

Him health insurance and I keep getting different answers on my questions.

First question, since we sponsored him (my husband is a citizen and brought his dad here), is the income question for the ACA our sponsored income or his income alone as long as we don't claim him as a dependent?

second, What are the repercussions of filing based 0 or limited income since we sponsored him?

Third, How the heck do we get him coverage when he doesn't qualify for Medicare or Medicaid?

It's one of the most overlooked things of people bringing elders to the US.

Basically, they pay for insurance. Medicaid is for people who have paid into it (it is why it is taken out of your paycheck).

They don't qualify because they never paid into it. But they can obtain it after 5 years I think.

They still can obtain insurance from the ACA. It is for everyone. But be prepared for sticker shock.

Who are you asking that you are getting different answers from? (just curious)

The best people to ask is the people at the marketplace. You can call the 800number or https://localhelp.healthcare.gov/#intro that link for a local walk in center to speak to a person in person...

What you should know: every state is different- some have provisions for LPRs to get medicaid some dont. Some allow for purchasing on the marketplace some dont. So where you are matters.

Generally speaking: You will never, not ever, in any circumstance use your income because you sponsored him as his income. Being a sponsor on the 864 means nothing except that you will reimburse for benefits he receives. So in your state if he applies for and gets Medicaid he would provide them with his info including who his sponsors are and they may choose to recoup money back from his sponsors for amounts they pay out in benefits to him.

You need to decide - and this is a decision YOU NEED TO MAKE as it is your household- if he is going to have his own income and be considered his own household separate from yours, OR if he is going to considered a dependent of yours and included in your household.

If he is in your household- you have to see about getting him on whatever ins you may have. This may or may not be possible as a parent-child relationship. Some ins plans allow this, some dont.

If he is his own household- according to the marketplace in Arizona - he needs to have income between $16,394 and $29,700 (silver plans) or $29,701 - $47,520 (other plans) over 47K and he wont get anything. Under 16k income he should get medicaid. If he is inelgible for medicaid due to immigration status or another reason, he needs to apply through the marketplace and indicate so- they will then process him. I believe the marketplace has a minimum income requirement of around 11k to be able to get insurance through it. So if you do not make atleast 11k or so you can not get anything.

For people in that situation- well they are out of luck. The marketplace gave coverage to a great number of people but it didnt cover everyone. There is still a great number of people that are still left out for one reason or another. Your father in law may unfortunately be one of them... :(

Unlikely you can buy outside the exchange.
