Hello,i find my self in the same scenario because my wife and I got married in my country this August.she filled an I-130 for me in November and it got accepted.The problem is that she needs me to assist her with the kids and house duties since her new work schedule is demanding, this means I need to be with her as soon as possible.i am therefore wondering if there is a procedure for getting there before the I-130 is approved by the NVC ...So my question is WHICH VISA DO I FILE ? K1 , K3 OR CR-1. Any one with info on this should pls comment.

No. You're on the CR-1 path and must wait.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You can visit her (subject to the usual requirements for visitors) and return home at the end of your visit to continue waiting.

There are no short-cuts in this game, I'm afraid. None of us likes the waiting or the separation but we will all get through it.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Unfortunately as others have stated, you already filed a I-130 and will have to wait for it to play its course. Your only option to come to the U.S. would be on a tourist visa and that's unlikely for 2 reasons. 1) Ghana rarely issues tourist visas. It would be a waste of your money. 2) You have a wife and kids and the US and have already shown intent to immigrate by filing the spouse visa. Even if you had very strong ties back home, it's unlikely they would give you a tourist visa.

I am sorry your wife is struggling right now. I know it's really difficult being separated from loved ones. Hopefully your case will move quickly. There are some tricks to speed up the process a bit when you reach the NVC phase. You and your wife should look over the wikis on this site and become familiar with the NVC phrase. Good luck!

Please don't give such excuses because it makes you look desperate. People have been through worst but they're stil waiting. Please Wait like everyone. You main focus should be the ability to overcome ghana embassy. They are tough cookies in there. Good luck on waiting.

If the waiting were your only problem you would be lucky. There is a mountain to climb at the U.S Embassy in Accra to even get the CR-1 visa for which petition has been filed on your behalf. I would be more concerned about that than the time waiting. As far as getting a visa visa at this time, your chances are virtually nil.

took my friend on here 6 years to get approved

good luck

but your wife needs to get the necessary help from father of the kids and her family here as it may be a long time till you are approved

get all your documents together and work on the interview

many from Ghana are denied 1st and 2nd applications

good luck again

not trying to be harsh or cruel but be patient and wait like all of us

No longer using K3

K1 is for financee only

Cr1 is for anyone married less than 2 years

the wait time after application is sent in is at least a year for the interview / many have gone longer to get one'

you have to wait as we all did / our journey started with K1 application in July 2009 and ended with visa approval in June 2015

it is hard when spouse is from high fraud country

you are going to have to prove your marriage is bona fide and you love this woman

You no longer qualify for K1 and the other options K3 or CR1 will take about a year. No way to speed up it except to keep on top of the process, be proactive and read and research every part of the process. Follow your country portal and get advice from other people in Ghana so there are no delays.

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Don't get confuse with the procedure. Once you married and have filed that is automatic cr1 as long as your marriage is not beyond 2 years. And that means you are no longer qualify for k visas. You can only wait and wait and pray you go through it smoothly without much obstacles from the embassy.
