Determination of american citizen child

Hi my son is 1yr old and he qas interviewed today nov.23 in us embassy manila. My aunt is the one who attend to bring my son in the interview since i am here in the us now and so my husband is.

My husband is the pettitioner he filed IR2 for my son. He is stepfather of my baby but his name is indicated as a father in my son birth certificate but he has no biological claim to my son. We apply for CRBA but since he is not the biological father we got denied. And he recieve a denial letter and so after i arrived in US and we got married we apply for i-130 for my son.. and so we got approval to have interview in manila embassy everything is ok but they still need one document wich is American Citizen Services citizenship determination for my son.

So what does it mean? Do they need the denial letter or what form is it and where can i find it?

Yes they need the denial letter, to make sure your son is not a US citizen before issuing a via.

Has your husband legally adopted your son? If no, how can his name be on the birth certificate as father if he's neither the biological nor adoptive father of the child? Sounds strange.

Because i was pregnant when we first meet and he doesn't know about it. Until i give birth he thought it was his son..but he found out that his not when we apply for CRBA.. but he still accept me and my son and he pettition my son again for I-130

so you fraudulently filed for a crba? I'm not an expert but that could cause an issue.

No i did not fraud the CRBA.. we submit origanal documents but they still asking for more documents so ..i dicided to tell the truth to the embassy and my husband..and they send us a denial letter..so thats how we started to apply for I-30 and we got approval letter but they want the determination for us citizenship for my baby..but we already apply for it and they denied it

you old them the truth after filing...you knew the child would have no claim to citizenship

I agree, it sounds messy. If I were you I'd get the birth certificate changed so it doesn't have his name on it as father.

The basis of the CRBA filing was the caim that the child's father was a USC while you knew all to well at the time that this was not the case. So I'd say that sounds fraudulent to me. You also submitted the birth certificate that lists your husband as your son's father which is also not (legally) the case. Also sounds fraudulent to me.

I believe the letter denying the CRBA is what they are wanting. A visa cannot be issued to a US citizen thus they need to know he has no right to US citizenship which was determined when the CRBA was denied.
