I actually think that this is the case. Some things are coming to the light and although I fell empathy for my husband and even for the parents as these aren't people with nefarious intentions, it is becoming too stressful for me.I didn't sleep a wink last night just thinking about the situation. Living separately from your spouse is no marriage at all. This is too much to handle. Plus his chances look even slimmer now that our new president-elect wants to crack down on this very type of thing. Funny how your past always catches up to you.

Thanks again for the replies

Gerogia, it's really good that you're there in France already. You need to get to the bottom of it regardless of if you want to live in the States...your husband needs to get his papers in order just for his own well being and yours. Maybe try being patient with his parents and just explaining that this is something that needs to be done regardless of where you guys end up living. I know it's hard being away from home...you've just been dealt a bad hand with this, try to stay positive...I would double check everything to make sure his French papers, Senegalese passport and everything are 100% clear and in order. Don't just take his or his parents' word for it, everything needs to be scrutinized.

If your husband is weary about moving to the US in the first place, you guys need to weather this storm first and see how it goes...but I'd say every step of the way needs legal expertise. You don't want him to end up getting banned for life from the US :(

I had the same experience in France in 2004. I flew into CDG and the immigration officer did not even open my passport. When I left through Germany, the immigration officer looked for a entry stamp, did not find it and asked when and where I had entered the EU. I told I had entered through Paris and he answered back: "the french".

Lol. The first time I entered on a U.S passport from Amsterdam I thought it was a mistake. I also flew to CDG. I was stamped in Amsterdam in both ways. On the second trip, they didn't look at any ID again...that was when I realized it was the norm. I have no entry or exit stamps in my passport to show I have ever visited France. But I have been there twice.

Hello all,

I need some serious help. My husband and I currently live in France and he has lived here most of his life. He was born in Senegal. Long story short, his parents forged documents and got him a fake passport/identity, unbeknownst to him. All of his younger siblings are legal French citizens. He has been living his life thinking that he was a French citizen and FOUR years younger than his real age. He discovered the truth last year and after the shock he went ahead got permanent residency in France. So his legal woes are straightened out in France. We had put the shock behind us and didn't give it a second thought until recently.

I want to move home (USA). For several reasons it just makes more sense for us to live in the US. Today it dawned on us that my husband traveled to the US twice last year and the year before on a FAKE French passport. I met him on the first trip. He only stayed a couple of weeks each time. But of course he was fingerprinted upon entry into the US. When he tries to return, with his Senegalese passport, he will be fingerprinted again and the system will pull up his fake identity. I am at a complete lost of what to do! Even if he can get approved for a K-3 visa (I'm still learning the types of visas) he will likely be turned away at the airport. The approval of a visa application means nothing if he can't even enter the country.I don't even know where to begin. I was thinking of going back to the US and petitioning for his immigration there and adding in an I-601 form; But what good would that do for the border issue? I'm infuriated with my in-laws right now! My husband had no desire to move to the US and would have preferred that we stay in France but I really need to move back home. He's only ever visited the US as a tourist! Any help is greatly appreciated. Does anyone know how the border control handles situations where someone has previously traveled on false documents but are currently legal?

I did suggest CR1.

Whatever you do, please be calm. Do not let your emotions guide you, put worry aside.

Wish you well in your immigration journey!

Thank you so much. I guess my fear and despair is pretty palpable right now. I'm definitely going to take a step back and really asses the situation before fully jumping in. We've been in a free fall over the past few days, lots of tears and finger blaming. My ignorance to this entire process is slapping me in the face. But we'll definitely use the lawyer...even if just for my sanity. lol. I'll be checking out some of the lawyers suggested in this thread because I don't know any nor do my friends/family. I never realized how detached I was from the immigrant experience until this. I'm definitely more sympathetic now.

(L) Thank you for the kind words! They are greatly appreciated right now. I definitely need to calm down a bit. Worry and stress won't keep my family together. I'm just so frustrated by the weight of their actions and of course my family back in the US are flipping out as well. "FAKE PASSPORT"!! "ILLEGAL IMMIGRANT"?!?! That's all they heard. I naively thought that everything would be easy peezy for us. That's not the case but we'll just have to fight for it.

Please let us know what advice you get from an attorney. Again, it needs to be one that has a lot of experience dealing with this kind of case. I've endorsed two in this thread and would recommend either. You might even want to talk to both before making decisions. "A good attorney" won't be good enough unless they've dealt with you kind of situation successfully before. The first things you need to know from the attorney is whether you can be successful and what it will take to accomplish it.
