F2a new visa bulletin and aging out

F-1 visa/status, F2A category - child under 21 yrs old of permanent resident

AOS (i485, i131, i765) package received October 7th 2016

Biometrics appointment November 22nd but did walk-in November 16th

service request December 21st (75th day) - answer case within current processing time

January 6th service request online (91st day)

got answer on January 12th that my case is on hold because they sent me RFIE on November 3rd and I haven't answered yet...I never got any letter, no updates on website, when I was calling them no one told me that they are waiting for answer for RFIE, they kept saying my case is under review

january 26th USCIS received my answer for RFIE

March 10th EAD/AP approved 

March 17th combo card mailed

March 22nd combo card received

I see your PD was current in March 2017. At that time you were 21 and 4 months, weren't you? How long did it take for your I-130 to be approved? If your I-130 had taken long enough to be approved (6 months or the longer the better), you would have become eligible for GC provided your I-485 was called for interview and approved.

I think you are right. You would still continue to be eligible for continued employment authorization until the F-2B category becomes current.

any news ?

my date is current in F2A but I'm going for info pass appointment next Tuesday to talk to them and see if I'm still in F2A category and I should get my green card soon or they put me in F2B

Hi Juliak and Texansforever,

 

it appears that we are on the same boat, but my case is a bit different that I turned 21 before my PD became current under chart B. But given that my I-130 was pending for 3 months, I will send I-485 anyways.

 

My timelines are:

 

DOB:07/26/1996

I-130 sent: 08/26/2016

I-130 approved: 12/01/2016 (95 days)

Priority Date:08/29/2016

On 10/01/2017 my PD is current under Chart B Date for Filing. Plan to summit I-485 on October 2017.

 

I turned 21 on 07/26/2017, but my I-130 was pending for 3 months. I don't know if my category had already changed from F2A to F2B on my 21st birthday, but I and my lawyer will go ahead and summit I-485 and try to receive the combo card and see what happens thereafter.

 

If CSPA age is calculated using the Final Action Date chart, then I will have to wait another 5+ years. I desperately hope that CSPA age is calculated when priority date is current under the visa bulletin USCIS announces to use (for October 2017, it's chart B) and the age is locked on the day I-485 filed as summiting I-485 is deemed that the beneficiary decides to seek to acquire status.

 

The worst case would be that my I-485 package will be sent back to me and I will resend it when my PD is current under F2B category.

 

I will join you guys and update any news.

I just noticed that if your I-130 PD is may 2015 and you sent I-485 on Feb 2016, but you have not received any interview appointment, either there is a problem or your case must have changed to F2B. I-485 processing time is around 1 year. I mean, I don't know if there is anything you can do to check the visa status or if the visa category has changed to F2B, but you should contact them at least to figure that out.

Believe it or not we went to an infopass appointment and they were unable to answer if his category had changed, they just said that since the application is pending he can continue to renew his Employment of authorization

Umm.. I have hired a lawyer and my lawyer thinks that I can send I-485 as of now despite the fact I described above, he told me that it is our responsibility to specify certain rules that may apply to us (for both of us, it is CSPA law). So if you do have a lawyer, you should invoke the law of CSPA and see how the officer that takes care of your case will do.

Yes please let us know you think their is hope that the cspa is calculated under chart B ? What does your layer said about it ??

Hello guys I had a status of F2A and when I turned 21 it became F2B and I had to get married so automatically they will be denied if I continue with the process. I have applied for my husband for a canadian permanent residence and there was a requirement to grant my husband a PR which is withdrawing my case. I did and asked the National Visa Center to cancel it. I need to get an approximate time that they will respond to me. Moreover, the canadian immigration asked me to get an official letter from USCIS about the cancellation but my case I-130 was approved by uscis and transferred to the NVC. So is it now only processed by NVC and they are the only ones to send me a letter of my case's withdrawal. Thank you

Hey guys it's really hard to tell if they calculate the cspa age on the date of filling or the final action my pd is September 12 2016 they sent me a welcome letter but every time I call and ask them about how you calculate cspa they answer once we start processing your case does that mean they can apply cspa now that I have sent all the documents? Or somebody here has different experience ?
