F2a new visa bulletin and aging out

You are lucky at least they answer something different when they answered me it was the typical copy paste 

 

The status of this service request is:

Due to workload factors not related to your case, USCIS anticipates a delay in completing your case.  USCIS is committed to adjudicating immigration benefits in the order received and in a timely and efficient manner. We regret any inconvenience that results from delays in processing.

 

they also answer this same thing last December Before the date was actually current so who knows! 

 

Question on is your date current under F2A? Or not yet

Timeline

It will be current in august. Then i'll do another service request.

F-1 visa/status, F2A category - child under 21 yrs old of permanent resident

AOS (i485, i131, i765) package received October 7th 2016

Biometrics appointment November 22nd but did walk-in November 16th

service request December 21st (75th day) - answer case within current processing time

January 6th service request online (91st day)

got answer on January 12th that my case is on hold because they sent me RFIE on November 3rd and I haven't answered yet...I never got any letter, no updates on website, when I was calling them no one told me that they are waiting for answer for RFIE, they kept saying my case is under review

january 26th USCIS received my answer for RFIE

March 10th EAD/AP approved 

March 17th combo card mailed

March 22nd combo card received

Unless they already transfered me to F2B and it won't be current for the next 5 years...

Omg!!!! How did you do that... did you adjust status? What are you supposed to do? Renew your employment authorization for the next 5 years? If you did adjust status how old were you when you submitted the Adjustment

Not an issue if Adjustment had taken place.

Is not for me is for my brother, but yes he was here under student visa and then did adjustment of status, he had already received his first employment authorization that already expired and has already received his second employment authorization (they are valid for one year) so in this case what would happen? Can he just keep renewing it?

If he has a valid basis, OPT for example. But that will run out.

That's the thing how do you go from a pending application for adjustment down to a opt for example or down to a student again if they don't give a clear answer on what category he is, we went to an info pass they said that if the application is pending he would be able to renew until he has a decision on the case but I don't know if there's a limit on renewals and they were unable to tell us if he is considered F2a or f2b considering that his visa bulletin said he was good to do adjustment the status

 

if you look up the latest visabulletins they say for adjustment you have to do the final action date that was not his case

Timeline

I applied i485 when I was under 21.  They said I need to wait till my priority date become current under F2b  before they resume processing my case.  My understanding is that as long as i485 still pending, we would be able to renew EAD and stay in the US.

Yes that's my understanding as long as the application was pending there are basis to renew
