F2a new visa bulletin and aging out

Oh if that's the case (I wasn't sure) then it all comes down to if they will take the filing date for i485 as the seek to acquire date (before turning 21)... is in my understanding that if your priority date comes current before your 21 birthday even if it takes them 8 months-1 year for them to approve it (and you turn 21) they can't punish you for that as long as you file as Hypnos said within 1 year

You substract the time when I-130 was pending, not i-485

AOS (i485, i131, i765) package received October 7th 2016

Biometrics appointment November 22nd but did walk-in November 16th

service request December 21st (75th day) - answer case within current processing time

January 6th service request online (91st day)

got answer on January 12th that my case is on hold because they sent me RFIE on November 3rd and I haven't answered yet...I never got any letter, no updates on website, when I was calling them no one told me that they are waiting for answer for RFIE, they kept saying my case is under review

january 26th USCIS received my answer for RFIE

March 10th EAD/AP approved 

March 17th combo card mailed

March 22nd combo card received

I-485 or DS-230 is considered "seek to acquire".

May 29 2015 priority date approved i130 July 21 2015 birthday October 9 2016 (21st)

So I-130 was approved after 2 months and 1 day. and that means your I-485 must be approved by December 10th 2016 if not, your category will be changed to F2B

Have you received maybe potential interview waiver? I've heard in this category (children of permanent residents) they usually don't do interviews.

If I were you I'd call them and ask what's going on with your case because it's been over 6 months since you sent AOS.

Priority date is not current yet on the final action and for the The December visa bulletin is still not current I predict it should be soon though (assuming it moves 1 month) the only hope is that as Hypnos says they take the age he had at the time he seek to acquire the i485 (February 2016)

So I-130 was approved after 2 months and 1 day. and that means your I-485 must be approved by December 10th 2016 if not, your category will be changed to F2B

no I told you, I called USCIS and I talked to the immigration officer and he told me that my I-485 has to be approved by the time I turn 21 + time waiting for I-130 approval, otherwise my category will be changed to F2B

To be honest with you I don't think that's accurate that's the hole point for the CSPA if your date is current and they are moving thing slowly and takes them a year to approve you is not your fault that it took them a year to grant the green card but I have to read more I'm on my phone right now that's why Hypnos says date when you seek to acquire... look that up seek to acquire that's when age freezes I have no doubt on that my only doubt is that in these cases will be valid since there's now two dates for visa bulletin... I've gotten random answers from this people on the phone before they read a script and have no idea what one is talking about when I asked about this they told me to do an infopass apointnent ?

Well the people that pick up the phones have no clue what they talk about that's why when I call them I always request to talk to an immigration officer and they call me back usually in a couple of hours bc no one wants to talk to those dumb people and everyone wants to talk to an officer. Go and make an info pass appointment then, because I'm really curious how they will be reviewing our cases and you're the one closer to having your date current.

Around 75 days it was quick yes I'm waiting to see when the date is current there are any changes if not all do infopass

Well the people that pick up the phones have no clue what they talk about that's why when I call them I always request to talk to an immigration officer and they call me back usually in a couple of hours bc no one wants to talk to those dumb people and everyone wants to talk to an officer. Go and make an info pass appointment then, because I'm really curious how they will be reviewing our cases and you're the one closer to having your date current.

btw since you sent AOS how long exactly did you wait for EAD?

What's the AFA date

If he's filed the I-485 then he can just keep renewing his EAD and AP for free until his priority date becomes current under the AFA date I believe.

At that point USCIS will schedule him for an interview and if everything checks out he'd become an LPR.

He is locked in once the I-485 has been filed.

Yes, he said my I485 has the be approved by the time i turn 21 + time waiting for I130 approval. I don't think they look on the table with final action dates once you submit i485
