At this very moment, my boyfriend has been rejected entry into the US and customs has cancelled his visa.

My boyfriend's visa was approved in October and he received it 5 days later. He was booked to fly here 11/21/16 first to Orlando, Florida too see his uncle and then fly to Philly on 11/23 to spend the rest of his trip with me in Delaware until 12/4. He was denied and his visa was cancelled however he is being allowed to reapply although I'm sure after this incident he will be denied. Customs claimed that the information he was giving for his purpose of travel was not consistent with what I told them and his cousin told them when he called.

He and I were already finalizing our paperwork in order to file for the k1 visa in February/March, but my question is how likely will today's events affect our chances for the k1 visa? Also, would it be a waste of money for him to reapply for the tourist visa again knowing they will see today's cancellation? Please advise because my family and I are devastated he won't be able to spend Thanksgiving with us.

So immigration called you and a cousin and the stories didn't match?

To answer your questions if you a seeking a K1 then it will be best to wait have him come on that. A new visitor visa is highly unlikely.

This event will not effect your K1.

Silver lining: K1's are being approved very fast recently.

Thank you for responding. So, you're saying this incident from today will not be an issue when we apply for the k1 visa? We've been together since March 2016 and I plan to file no later than March 2017. I've been to Jamaica at least 4 times this year plus we went to the Bahamas for his birthday so we have plenty of proof. But I wanted him to come here first and see what's it like but now that plan has been cancelled. I just don't want this to hinder him in the future.

Correct, it will have no affect on the K-1.

A B1 visa is for a business trip or similar. If it's not with the B2 connection, it is not a visa that should be used for pleasure. I can see why your boyfriend got denied entry if the people that are being called say that he's going to visit friends/family.

When I received my B1 visa I was told by the American Chamber of commerce, the organization that I went through to get this visa, that I should under no circumstances ever use words like vacation or visiting in front of the CO or CBP officer as the B1 visa is not supposed to be used for that. I'm surprised why your boyfriend received this visa and not the B1/B2 combination visa.

As others have said, it will have no bearing on the outcome of your K1 visa application.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So I'm here with my fiance (came to visit him after his horrible experience during his POE in Orlando), and reviewing his paperwork, he told me that they took him over to Orange County Jail, fingerprinted him, strip searched him, and held him in a jail for 3 hours. However, he was not charged with any crime, and then put him on the plane home to Jamaica.

My question is, now that he has been fingerprinted in our system, doesn't that show here when he's fingerprinted on the day of his interview? Again, he has not charged with anything, they just cancelled/revoked his visitor's visa because they felt that he was coming to the US for more than coming to visit me. I just want to make sure that this event doesn't affect our chances during the k1 visa process because I plan on filing in January/February 2017.

FYI...my fiance has never been in trouble with the law in Jamaica or any country!!!!

Thank you to everyone that has responded. One last question and I apologize if my questions get on anyone's nerves....

Based on this incident, will I have to file the I-601 waiver form when I file the K1 visa? I'm inclined to think I wouldn't because he was denied entry at POE, and wasn't allowed through. Based on the criteria for the waiver form it doesn't seem as if this situation would qualify for a I-601. Correct?

No you would not. He was denied entry, not banned. Being denied entry and leaving is fine. It just means they thought he was trying to stay.

Thanks for responding. I'm filing the K1 visa in February/March and I'm going to see him on the 31st to break in our first New Year's together and staying a week to celebrate my birthday. I've been to see him 5 times this year so we have that part covered! ?

No you would not. He was denied entry, not banned. Being denied entry and leaving is fine. It just means they thought he was trying to stay.

File the K1 ASAP, he wont get another B1/B2 soon

he needs no waivers & it wont affect your petition,

make sure you been face to face in the last 2 yrs
