Hey VJers

The first which was the last time I posted on here was when I was going through a real rough patch in my marriage even leading to divorce.

Briefly (even though you can view my previous post on My profile page)

My husband had been constantly threatening to file annulment based on fraud.I moved out of the house (with the help of the of the police) and lived with a close family member of my husband with my kids.

He then had been showing up there and he told me he didn't file annulment even though he had threatened me that he had. He also was trying to mend things and promised me to make things better for me. I move back with him and nothing much have changed. We have come to a point now and have agreed to have a divorce I.e to file a joint petition and our appointment with the lawyer is tomorrow. He is now not so against me staying here in the US compared to before when he was threatening me to take me back or deported. He has acccepted that i can stay here in the US without him.

Our divorce is suppose to be finalized in 60 days apparently.

Well now I have to ROC alone as soon as I get that divorce decree which should be late Jan next year.

My main concern now is the evidence that I have so far with me to submit with my petition. Mind you my husband was against me working.. just only with him occasionally for his business. So I didn't have any income and no drivers license (he was against me driving) i currently have no life insurance. The very next day after I moved out he went to the bank and took my name off the account (which I just found out was not a joint one but one where I was just the authorized signature) and took me off the life insurance as beneficiary.

What I have now is just *a few pics of us and family, a box of business cards with my name as owner(which he printed before I got in here to the states_b4 d drama) fssa documents showing his name and my kids names. He is going to file taxes as married early next year with our divorce pending which I will submit also. Im thinking of getting my learners permit a week from now ... That will show my address here which I can send with the petition _ is that a good idea right now? I will of course have affidavits from friends and family.

I'm thinking of filing the petition based on our bona fide relationship. That seems to be the better option considering my situation.

He says that I can stay here with him even after the divorce.

Oks I would love any advice from you peeps no judgemental ones please

Try and gather whatever you can. If possible as it seems he's coming round to the idea of you remaining in the US, can talk to him about providing evidence of the account before he took you off? A bank statement, any copy of the life insurance previously as surely he'd receive formal notification of who the beneficiary of the policy was.

Statements from friends and family too... especially those of his family that can attest to it being a genuine marriage originally in their eyes and that you had family members on your side through the relationship break down. Won't be the primary evidence reviewed but goes some way to illustrate you weren't here to use him as I doubt his family members would have come to your aid otherwise.

This last part may get you in problems. He's willing to have you leave with him after the divorce? You're going to have a hard time proving your marriage was real.

When i divorced, my lawyer advised my ex and i, that we couldn't remove each other from life insurance policies until divorce was final. I do not know if this is state specific or not,but maybe something you can look into.
