Hey I have several questions regarding the k1 and k2 visa. The K2 guidelines are not very clear.

1. What additional forms are needed for the child? Do I just list her on the I-129f?

2. What additional fees are included with the I-129f package for a k2 visa?

3. My fiancee's daughter is only 4 years old and her father is nowhere to be found. How do we go about proving that she is allowed to come here?

Any assistance is very much appreciated.

Hi,

No additional forms are required, just make sure you list the child/children in the I-129F application. The fee remains the same, regardless of the number of children listed, when we filed it was $340, not sure whether it has been revised....you may want to confirm this. To the best of my knowledge, parental consent must be given to allow the other parent take the child out of the country. You may have to find the other parent or seek help from the children's court...

1. What additional forms are needed for the child? Do I just list her on the I-129f? Initially just list the child where indicated on the Form I-129F, later on at the embassy/consulate phase there are required forms/exams/fees to be paid. See link below

2. What additional fees are included with the I-129f package for a k2 visa? None initially, as per #1, later on as per #2

3. My fiancee's daughter is only 4 years old and her father is nowhere to be found. How do we go about proving that she is allowed to come here? Will have to research/follow the laws of the fiancee's country regarding obtaining parental approval for the child to immigrate.

Thanks, for all the help. I have one more question though.

I just found out that the father is not even on the birth certificate. Will this help with getting them over here? Or do we have to perform a miracle and locate this guy still? My fiance has sole custody over her daughter, as the only parent on the birth certificate.

As I mentioned before:

Will have to research/follow the laws of the fiancee's country regarding obtaining parental approval for the child to immigrate.

You will have to research and follow the laws of your fiancee's home country (which is unknown at this time, since your timeline is vacant) with regards to the child's immigration status. With all of the international concern for child trafficking, it is highly unlikely that any interviewing US embassy/consulate would issue a K2 visa until all of the respective laws of the home country are followed and there is appropriate documentation to that effect.
