K1 and adjustment of status questions

Good Afternoon,

My wife is here on a K1 Visa from Vietnam. We were married before the ninety days. We are working on the Adjustment of Status and other documents.

I have several questions:

  • My wife served in the Vietnamese Army for one month while in college. She tells me all her classmates had to do this. She said she received no weapons training. I confirmed this at the range a few weeks ago. Does this need to be reported on I-485 Part 3C (p3), question 15a (p4), question 18 (p5)?
  • She received a medical exam just prior to her visa being approved, but she elected to receive her vaccinations in the States. She just got added to my health insurance and has an medical exam scheduled for early December. Do we need to wait for her vaccinations before we can send in the I485?
  • We were married well before the ninety days and she is asking me if we need to worry about the petition expiration date and the visa expiration date that are on her visa. I honestly do not know what the answer to these questions are. I figure we are safe because we are planning on submitting the package before the ninety days expire and we have a marriage certificate.

  • She received a medical exam just prior to her visa being approved, but she elected to receive her vaccinations in the States. She just got added to my health insurance and has an medical exam scheduled for early December. Do we need to wait for her vaccinations before we can send in the I485? If you submit an incomplete DS-3025 or omit sending in a completed I-693, your will likely get an RFE. See below.
  • We were married well before the ninety days and she is asking me if we need to worry about the petition expiration date and the visa expiration date that are on her visa. I honestly do not know what the answer to these questions are. I figure we are safe because we are planning on submitting the package before the ninety days expire and we have a marriage certificate. Once your wife entered the US at her POE, her one-time, one-way K1 visa was null and void, therefore the various expiration dates you mention are moot. See below.

She married you within 90 days, that fulfills the K1 visa requirements. She is now in a "special status" and the general forum recommendation is to start the AOS process as soon as possible. There is no specific time frame requirement to file the AOS. However, the sooner the better.
