That is because there is no waiver for a K1. There is one for the CR-1 spousal visa, as there is now a US citizen spouse who may suffer hardship.

That being said, the code your visa got denied under is quite serious, you may want to consult with a lawyer if you are not willing to say here what exactly happened so we can help you.

It's a very common mistake to think that K1s can't file waivers but they do. I've even heard of lawyers who thought the same. The truth is that there used to be a rumor that K1 waivers barely ever get approved because the hardship is not very strong due to the fact that the US citizen partner isn't even family yet. There's been lots of K1 waivers getting approved though, it supposedly used to be a lot more difficult in the past. However there's still the recommendation to first marry (and then go the spousal visa route) before filing the waiver because the hardship case will be considered stronger. Good waiver lawyers like Liz Cannon also do K1 waivers successfully.

i didn't lie and submit false documents.one mistake that i did was a soon as co go for looking something i was making ready (bring out) my documents.

starting from that moment he was completely changed .i think i have to wait til the co asks me my evidence.

What does mean prove extreme hardship to your US citizen partner?

You've got a misrep charge and seriously never looked up how to overcome it??? And you never tried to find out why you got a misrep charge which means a lifetime ban from the homecountry of your spouse???? This is very serious!

Just type into google 601 waiver hardship and you find hundreds of pages that explain it and give examples. A better forum than VJ is immigrate2us. Visit that forum and you find a lot of hardship letters and examples on how people proved extreme hardship.

A good website for you to start is: http://www.nolo.com/legal-encyclopedia/proving-extreme-hardship-us-relative-immigration-purposes.html

Gathering these documents to prove hardship and find these arguments usually take months so get on it asap. Also don't rely entirely on your lawyer. Your waiver case will only be as strong as the arguments are that you will provide your lawyer with.

You really need to find out though why you got a misrep charge.

Their is something you are hiding...you have a lifetime ban for a reason ie. U used a fake document before claimed to be a us citizen are married when u said u werent...

You need to really think about what u did to get a mistake rep and go back and read the letter it should say what it was
