In 2015 I was still married to my ex and already in relationship with my fiancé right now, I apply B2 visa and told the embassy that I want to visit my husband but I just want to visit my fiancé and go find my ex to give me thumbs print for divorce but they deny my visa because they think I would stay there. After I find a way to get divorce and filed k1 visa and my interview was yesterday

The same girl who interview my B2 visa come to interview me on my K1 visa. She asked about my last marriage and my B2 she Don't like me at all that I lied to my B2 visa.

She also don't like it that I am in relationship with new guy before divorce. Now my k1 rejected is under g221. What I should do now to make it better?

We thinking about getting married and apply for CR1visa. any chance that we can get Visa Aprrove for next time?

Was it denied/rejected? Or did they ask for confirmation of divorce?

If they actually denied it, perhaps they assume you "misrespresented" yourself on the B2 attempt?

What exactly what said during the interview?

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I have divorced degree during interview, the co only forcus and trying talk about my B2 visa and me in relationship with my fiancé while I'm still married

I try to tell her that we broke up before I met my fiancé and she said to the guy next her why wait so long to get divorce? She just try with one guy not work and try with the next one. And finally she told me that it is incredible and she think I only want Imigration benefit.

I asked her what I should do? She said if he still interested he will refile paperwork again. But I can tell that she mad at me that lied to her before.

I don't think they could think that she misrepresented herself because in order to call it misrepresentation it would have to be material. It wasn't material in her case as the visa interview would've had the same outcome even if she had said the truth. Also she didn't benefit from her lying during the B2 interview as her visa was denied anyways.

That is of course if you meant the misrepresentation regarding visa interviews.

How much time was in between the divorce and you filing for a K1 visa?

You have to understand that it does look fishy to CO that you get so quickly into a new relationship again with a US citizen (what a coincidence!!) so that they will scrutinize you. The lying just did the rest. You were very unlucky to even get the same CO too... so all those factors just added up.

I don't think you should have issues if you go for a spousal visa though. In order for it to look like a genuine relationship get a lot more face to face time. Immediately filing for another K1 isn't going to help unless your fiancé would spend a lot of time with you in your home country. Like a looooot of time

It was one few months after legally divorce, we plan to get married anyway and he will move to me in October 2017after he finish his MBA. is that would help? Thanks everyone for answering my questions

Yes, since he plans on moving abroad anyways, leave the US visa process for now. After you live together abroad for a few years, it will be much easier to get a visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

In my case, me and my fiance were together a year before his divorced was finalized. The i-129f was in the mail the day we received the decree lol. It was never questioned. Divorces can be lengthy and I don't see why they would give you a hard time for being with someone else while still legally married. I guess they are upset because you were dishonest. At least you have come clean now. I hope it all works out for you in the end!

Never ever lie to immigration. Hope you learned your lesson (the hard way). And what Penguin says, it'd be easier after a few years of him being there.

I don't see how you lied during the interview though. You wanted to visit your husband, so you could get divorced.. You also wanted to visit your fiance but one doesn't negate the other. Not volunteering information isn't the same as lying. Sounds like CO just didn't believe your relationship was genuine.
