AOS Submitted but no confirmation

Timeline

I sent the AOS package to the Chicago lock box address by FedEx more than two weeks ago. I got FedEx confirmation that is was delivered but I still have not received a NOA nor have they cashed the check for the application fee. My Fiancee's visa expires in less than a month. Should I be worried? How long should it take to get the NOA after submitting the application?

Two weeks would seem awfully fast to me for an AOS. You might get a receipt, but I don't think they'll approve it that quickly.

Maybe an InfoPass appointment to the San Francisco office to see if they can extend her visa? (The wife had a bad experience at the San Francisco office, and she was from Indonesia, so make sure you go there with your fiance to avoid any issues.)

And you say your fiance. I assume she's not here on a marriage-based visa. Are you guys getting married at some point?

Thanks for the reply! Sorry I wasn't clear. She is now my wife. We submitted the I 485 package and associated forms per the checklist on this site. I'm just waiting for the receipt that they received the application - I believe this is in the form of an I-797. I have not received this nor have they cashed the check. I just found another thread from 2 years ago with the same concern. It seems at least back then that the wait could be up to 30 days. I'm just worried that that is cutting it close to the 12-12 date stamped on her K-1 visa.

Hello,

What status is your fiancée adjusting to? What visa does she have? If she came on a K-1, you got married within the 90-day period and she's adjusting to become a permanent resident, you don't need to worry about her visa expiring.

It is normal for them to take around 2 - 3 weeks. I got my NOA after 15 days of them receiving my applications.

In that case, your wife and you have nothing to worry about. My visa expired a week after I sent off my AOS/EAD. Some people actually take years to apply for AOS, sometimes for financial reasons. As long as you got married within the 90-day period, you're good :)

Timeline

K-1 visa are invalid once you entry the United States as it is a one entry visa. Once you entered the expiration date on the visa does not matter anymore. You have to get married within the 90 days period. If you did that nothing to worry. You should get an update shorty.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
