Mistakes in I-130 after NOA1

My husband filed I-130 for me and we already received back the NOA1 some days ago. After that I noticed that we made at least two mistakes. There was not a copy of the backside of his birth certificate AND no cover letter.

Are these a huge problem? The cover letter was not mentioned in the uscis instructions. Can we provide those to them already rather than wait for RFE?

Hey Mudyah,

It's hard to definitively say whether either of these issues will lead to an RFE.

The cover letter should not cause any problems. It's not TECHNICALLY required, but is usually recommended since it helps the USCIS reviewer figure out what types of evidence you've included.

The birth certificate may be more of an issue. I know for my birth certificate from New York there was a barcode on the back, so I made a copy of both sides (front and back). Was the back of your husband's birth certificate empty or blank?

In either case, there's really nothing you can do now. Sending additional information is likely to be a fool's errand as there's no guarantee it will added to your application at this point. You can feel free to call the USCIS customer service hotline and see if they're willing to add additional information to your application, but I suspect this will be difficult. I personally would just wait it out; it's entirely possible that there will be no issues.

I am the USC, I didn't send a copy of the back of my birth certificate because its empty. Maybe i will get an RFE, maybe not, i will wait and see like you!

October 31, 2016 I-130 sent to Chicago Lockbox

November 4, 2016 Received text case sent to Nebraska

November 10, 2016 Received Hard copy of NOA1

The cover letter is not needed so you will certainly not get av rfe for that. The birth certificate or depends on whether or not there is something on the back of it. I think you have to wait to see if you get an rfe at this point instead of sending it in now.

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:
