Hello All,

Can anybody tell me whether it is possible for my English fiance to enter the US after i have received the NOA2 and after the UK consolate has received our package? He would like to stay here until his interview date is set and then return. Has anyone else had a similar situation and can offer advice. I know there are restrictions on him entering and that he could be turned away but am unsure of exactly when this is from and if the chances are higher once it reaches this stage.

Any info would be great.

Jan 16, 2007: NOA1

April 9, 2007: touched (in the afternoon- Monday)

April 9, 2007: RFE notice via email (11:30pm- Monday)

April 12, 2007: RFE hardcopy received in post(Thursday)

April 14, 2007: touched (Saturday???)

April 16, 2007: Sent off more evidence to CSC (Monday)

April 17, 2007: Package arrives at CSC (10am Tuesday) (post office receipt...no notice of receipt from CSC)

April 24, 2007: email notification that CSC received my RFE reply on Apr. 24

April 24, 2007: touch

April 25, 2007: touch

April 27, 2007: touch

April 27: 2007: NOA2!!! (8:20pm email)

April 28, 2007: touch

May 2, 2007: NOA2 Hard copy received in snail mail

May 10, 2007: NVC received petition

May 30, 2007: Packet 3 received in post, scheduled medical appt.

June 12, 2007: London Medical

June 4, 2007: Packet 3 returned to Embassy

June 22, 2007: Packet 4 received

July 25, 2007: Interview!!! ...Approved!

Good reply the FAQ has the answer to this on, and yes it is asked so many times that is why it is in the Frequently Asked Questions!

Yes, I realize that the answer to the question was in the FAQs, however, I meant to specifically ask if anyone has entered the US after the I_129F has been sent to the consulate & if they were able to enter without problems. Since the answer is so vague in the FAQs, I was looking for people who have been in the situation. The posts I have read thus far regarding this question have not addressed experiences of people who's I-129F had already reached the consulate. Has anyone visited their fiance' after the I-129F has been sent to the consulate & did you have problems?

Not sure if this is any help.... But i was in the USA when we recieved the NOA2... we then got packet 3 which my mum posted out to me, and i sent it from florida to london, then once i got packet 4... i booked flight home.

Not exactly the same situation as I was already in country, I didnt have any problems at all entering through immigrations... I took lots of proof of ties to UK, but was never asked for it!

I visited NYC the Wednesday before my interview back in London the following Tuesday and there were no issues at all, just the routine questions at immigration. My interview was fine and the visa was approved. Obviously this was just my experience (and I had all the evidence of ties to the UK with me plus my invite to interview letter from the embassy) but I don't believe this has an effect on your petition, from what I had read I expected the fact that I had a pending visa application to be relayedelectronically to the border guard once my passport was scanned but if it did then he did a good job of totally disregarding it...

I wasn't going to visit at all but got sick of wedding planning via the internet so decided it was worth the risk, plus it says on the US embassy website that you are entitled to visit whilst your application is pending, at the end of the day it is a judgement call I guess!
