Hello,

This is my case in a nutshell:

  • My father got naturalized 6 months before I turned 18.
  • I was born out of wedlock.
  • I've had a GC since I was 2 years old.
  • I'm now 25 years old.
  • I've never lived with him so there's no record of physical custody.
  • He did list me as a dependent on his tax returns.

My questions are:

  • Is it easier to apply for a passport instead of filling for the N-600?
  • Will I need to provide proof of physical custody if I apply for a passport? If so, are the tax returns sufficient?

Applying for a passport and claiming citizenship under the CCA is your cheapest and fastest route but may require digging up documentation that you can't produce. I would try it with the tax returns as you'll have an answer within a few weeks.

The N-600 will also require similar documentation, cost several hundred dollars more and take a few months or more.

If you don't want to bother with it all, or if the passport route turns out to be more trouble than its worth, just file the N-400 as a long time legal permanent resident.

Not a bad idea to consult a competent attorney but they're not cheap and you have solid fallback option (N-400).
