B1/B2 AOS QUESTIONS

My girlfriend and I have been together at like least 2 years, we've been studying together for this 2 years in the same art college, both graduated from the same school. We meet each other in the first year of college and now we were here 2 years ago. Now she is Florida and she wants me to move with her, but I'm not an American citizen like her, I'm from the Dominican Republic.


I have a tourist visa for 10 years, so I can go to visit her. I went to visit her in October and we talk about this subject. I'm going to US now in December again to be with her at Christmas and stay for 2 or 3 months in my cousin's house


I'm a freelancer graphic designer and 2d animator, Iwork from my computer so I'm always in vacations :P. I have a tourist visa since 2010, I traveled a lot to the U.S. visiting my cousins and some more family I have there.


The thing is I want to marry my girlfriend this December but she doesn't know anything I know I can't go to the US with the intention to stay or with anything that they seems like I want to stay (rings, paperwork, etc.) I know that. Everything that I'd do like buying a ring and its there's going to be when I arrive in the US. But I have a question, if I get married with her and I stay for 2 to 3 moths there I can go for an AOS?


My girlfriend have 2 jobs she do like 29,500 a year(I'm saying that because there's a minimum that Idon't know) she lives with her best friend (roommates as well). What about if we do the AOS and in the interview they ask "why you don't live together"?


I know I can get married and go back to my country DR or get the K1 but I wanted to know about this exact situation.

I'm pretty sure that the fact that you've clearly thought it over (AOS from a B1/B2) and posted about it on this site would make it visa fraud.

If you come to the US in December and propose to her, and go back home she can file for a K-1.

If you come in December and propose AND marry her legally(yes you can legally marry her while in the US), then you go back home, then she would need to file for a CR-1 visa for you.

As was stated, it's just having the intent that makes adjusting on a tourist visa the fraud part.

The decision is up to you on which visa route is better for the both of you.

your plan is fraud even if your girlfriend does not know anything about it. it also seems like you are trying to force her hand by suprising her with marriage and then wanting to adjust status.

I would recommend filing for a k1 vIsa since they are faster and there is nothing to stop you from visiting while it is pending since you already have the visa.

That you're considering this is tantamount to pre-concieved intent. Do not enter on a B2 with the intent to AOS. Ignore the other voices encouraging you to AOS on a B2.

You have two options. Propose to your girlfriend, then exit the US and have your new fiance petition you for a K1 fiance visa.

Or, get married while visiting, then exit the US and have your new wife petition you for a CR1 spouse visa.

Yup again as I stated already. This is the correct, legal way to go about this.
