AOS on VWP - Moving from the UK (introduction)

Hi everyone!

Firstly wanted to thank every contributor to the site - it's been invaluable in making my dreams come true!

My fiance & I met online while we were both at Disney World in Florida on holiday.

I was visiting from the London, England, he from Seattle, Washington.
We went on a couple of dates before making our own ways back to our respective homes.

We then spent the next 15 months travelling back and forth to see each other (I've never racked up the miles so quickly! British Airways made a fortune from the pair of us!), before deciding to spend three months together in Seattle to see how we fared on a more 'everyday' schedule. It worked out so well we've opted to get married before my visa waiver expires and file for AOS while we stay together - thanks to info and others' stories right here on VisaJourney.com!

It wasn't our intention to do it this way (we'd talked about filing for a K1 when I got back to London), and we were both convinced that AOS wasn't possible on the VWP, but after some serious research and digging on here it turns out quite a few couples have done it in the past, so we're embarking on a similar journey.

Our ceremony is happening late November at a major local landmark, our marriage license is in hand, my medical is done, and I'm just putting the finishing touches to our big pack to send to USCIS the day after we're officially married.

September 2015 to 2016 - 65,000 miles flown between us as we did the LDR thing / 28th Nov 2016 - Married at the Space Needle in Seattle 
29th Nov 2016 - Concurrent filing of I-130, I-485, I-765 & I-131 sent to Chicago 
13th Jan 2017 - Biometrics / 3rd March 2017 - EAD/AP card arrived

14th Sept 2017 - Interviewed at Seattle local office. Card production status updated 6hrs later! 
21st Sept 2017 - LPR / Green Card arrived in the mail (via USPS Priority Mail)
20th June 2019 - I-751 Filed to Arizona / 29th June 2019 - NOA1 mail/written confirmation arrived with 18 month extension; LIN/Nebraska case number 
15th Nov 2019 - Biometrics taken / 19th May 2020 - New 10-Yr Card Being Produced / 22nd May 2020 - 10 Year Card received in the mail!

17th June 2020 - Submitted N-400 online, estimated case completion August 2021 (Biometrics reuse letter 
received Dec 2020)

11th August 2021 - Interview notification received / 28th September 2021 - Interviewed & Naturalized at Seattle FO

Oh dear, you want people on here to wish you luck.

I think you've just set the hounds of VJ users off on you! You are going to hear plenty of people telling you it's not fair, you're cheating the system.. you give others who are doing it the "right way" a bad name...

I'm sure someone is going to mention fraud too!

In any case if you believe that this avenue is open to you and precedents have been set of other couples having done this from a VWP then go for it. Expect t a huge amount of scrutiny obviously and I mean from immigration officials not the sour pusses who will want to deflate your optimism on here.

4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Thanks guys; I realise some may not appreciate or know the specific details of our situation, but I'd hope not everyone is mean! In our case, we'd at least like to get the forms in as soon as possible ahead of what could be a tumultuous time in not only immigration matters but also LGBT issues with the incoming administration.

We've both been reading all the guides, sample forms and threads from others who've followed the same path that we're going down. I feel confident we've met all the requirements and can prove we didn't originally intend to do this (the wedding itself is taking place on Day 85 of my time in the US).

We've been fortunate that a lot of things have aligned for us when it comes to work, travel and money, not to mention the support of friends and family.

It's obviously nerve-wracking because there a lot of forms, stages, and processes to follow, but with the info here I feel a lot more confident.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Once married you become an immediate relative. Immediate relatives can adjust status in country.

Don't sweat, they won't even question whether you have intent or not upon entry because that's not relevant! Many people will tell you that they will scrutinize you (just to make you uneasy) but truth is, if you have a legit relationship, they cannot deny you the GC!

We are also same sex marriage and I adjusted from b1/b2 and the interview was a breeze. Never talked about intent for one second. She asked the usual questions; how we met, the timeline, the proposal, looked at some pictures, and we were good to go.

So I say, relax and be candid at the interview.
