So...here's my situation...

I am a 23 year old man who is the US Citizen petitioner for my UK wife's CR-1 visa. We're now at the NVC stage and I need help on the Affidavit of Support as I am extremely confused and don't know where to begin.

I've only been working since early 2015 and even then, my employment has been sporadic and inconsistent (I was fired from one job for some retarded made-up reason, I was laid off from the next, and my current job has inconsistent hours as it is an on-call basis). Before early 2015 I was a full-time college student.

With these facts, it's pretty safe to say I don't meet the income threshold set by the US Government. My mother has agreed to be a joint sponsor, who does in fact make above the threshold.

I currently live with my mother, and my autistic sister. Once my wife obtains her visa/Green Card she will be living with myself, my mother, and my sister, until I finish college and make enough to where myself and my wife are able to move out.

My question is, how do I go about this Affidavit of Support? Which exact form should I use? What should my mom use? What documents do I need to provide? What documents does my mom need to provide? How many documents do me and my mom need to send for the NVC to be satisfied? ect. ect. ect.

No need to worry.

You, as the petitioner, must complete an I-864 even if you don't earn a single cent. It's clear from what you say that you don't earn enough to qualify on your own and that's great that your mother is going to help out with this process.

Your mother needs to prove she makes enough to support herself, your sister and your wife. I assume your sister is still a dependent of your mother's due to her medical situation?

Your mother can use form I-864A as she is your household member. She will also need a copy of your birth certificate to prove she is your mother. She will need her 2015 tax transcript which she can download for free from the IRS 'Get Transcript' website https://www.irs.gov/individuals/get-transcript

If you've got this far, your wife is almost home. Not much longer to wait now.

You also need to send a tax transcript. If you haven't filed for 2015 then you need to attach a letter explaining why you haven't filed (didn't need to because income below tax threshold).

  • Scan date: April 14/ May 7th (NVC said both I dont know why)

Since the embassy is more interested in the sponsor's current income, your mom will also need to provide evidence of this. Evidence of current income includes pay stubs and a letter from her employer confirming she has a current job there and outlining her annual salary. Only the most recent year's tax transcript is REQUIRED for BOTH you and your mother, but I would highly recommend bringing the past 3 years just in case. As someone already mentioned, they are free to print out online :) Good luck!

Also, in addition to your birth certificate proving she is your mother, she also needs proof that she is either an American citizen or a permanent resident. So green card if a LPR, or passport or her own birth certificate if she is a citizen.

Also, we also had our interview at London. Although the tax 1040s aren't mandatory, we brought them just in case, and they ended up keeping them. So it's better to have something in case they want it, than assume they won't want it and then be wrong.
