Hello,

I'd like to know if I can obtain a certificate of citizenship under my specific circumstances:

  • I'm now 25 years old.
  • I was born abroad and out of wedlock, my parents never got married and he's married to someone else (since I was 2 years old).
  • I came to the US as a LPR with a green card when I was 2 years old (I never came to the US illegally)
  • My father because a US Citizen through Naturalization when I was 17 years old.
  • I've never lived with my father which is why I didn't apply when he got Naturalized.

Do I have US Citizenship through his Naturalization or do I have to apply for Naturalization by myself?

If I do apply to fill form N-600 and obtain a certificate of citizenship, what documents do I have to attach?

You were not in his physical custody so that disqualifies you. What about your mom?

You can just apply the N400.

However, he always added me on his Tax files as a dependent. Does the physical custody matters now that I'm over 18?

My mom isn't a US Citizen.

It matters that you should have been in joint and physical custody of your dad during the time before you turned 18.

Being a tax dependent is not a requirement.

Just wondering, how did you immigrate? What type of visa category?
