I was brought to the US as a 14 yr old by my mother (Without inspection) she left me here about 6 months later when she went back to Mexico without even a goodbye but I was with a relative who is a permanent resident and stayed with her until I was able to take care of myself. I finished Jr high and High school, never been in trouble at all; that was in '95 fast forward to 2016 and now as a 35 year old I'm still without legal status I missed DACA because I was already 31 when it was announced and therefore unable to apply. I am married to a US citizen and have been for the past 8 years, we have 2 beautiful girls and now we are trying to figure out how we start the process I know we need to send in the I-130 first but I was told a few years ago to not do it because I would have to go back to Mexico which I just can not do for the sake of my family. My question is would there be a way to stay here while going tot he process without having to go back? I'm afraid of my daughters growing up without their father to be there and provide for them from the other side of the border. I'm lost and not sure what to do as we are fairly low income and can't really afford to hire a lawyer so I figure I would try here first before going that route. Sorry for the long post and thank you in advance for your help. Carlos

hi

you will need to go back for the interview, since you entered illegally in the country

but before that you can file a waiver since you do have a 10 year ban, while you are in the US, if it is approved you can leave to have your interview
