K-1 vs TN Visa

Hello VJ world,

I wanted to ask the gurus and experts on this site for an advise on my current situation.

Background:

My Fiance received his green card in early July. Shortly after this green card, he got a very good position in state of NY and moved there from Canada. He does not have a USA citizenship however only has a green card.

After he had moved - I also started to look for jobs in near by area and have been interviewed by couple of companies for a position as Medical Lab Tech (it is also in the list of NAFTA occupation). One of the companies called and said they are willing to bring me on board. So things are looking bright from that front. We also have a little 8 month old.

Now I started to do a little bit of research and found that I will be obtaining a TN Visa at the border when I cross. From what I read, TN Visa holders should not have an intent of not permanently living in USA. In my case, that is not true as I am planning on living here with my Fiance (soon to be husband as soon as we figure all this stuff out).

What is the correct way of going about doing this? Should I obtain my TN Visa at border? What if they ask me about my child and his father and I say he lives in USA (as a green card holder) - would that cause any issues?

Should we also apply for K-1 Fiancee visa? Would that deter my TN Visa by any way?

I am really confused as to which way should I take. I wanted to consult here before I hire an attorney (lots of $$$ and with a little one - its kind of tough to afford one right now)

I really look forward to hearing from the members here and see if anyone can provide any sort of guidance and/or advice. I thank you for your time in advance.

Regards,

Mila K

K1 is out USC's only

TAkes a couple of years assuming you are married so the arguement for using a TN in the meantime, should it come up, is that you do not intend to immigrate on that but later through other means.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
