Yes he can file while abroad.

When you say his immigration status - you are referring to his visa status in Poland? He is not immigrating to Poland - you are immigrating to USA, right? I would avoid any mention of immigration and Poland whilst you work on your immigration to USA.

How will he prove income is USA? Will he have a co-sponsor? Not an issue for the I-129f but you need the I134 for the interview.

The London story is confusing. It sounds like he was denied entry to the UK because of his Polish overstay. Has no relationship to the USA - we have to take him back!

Yep, the officers in London pretty much said he's Poland problem. Correct I'm immigrating to the US, hopefully if all works out. We will utilize all of your information and help. I truly believe we will be approved, fingers crossed right?

Yes, he has an amazing job still... Very close friends with the CEO. He also will have a Co sponsor incase. We're taking all things into consideration we just needed some definitive answers. We are aware of all forms and requirements but if there's any "tips" we're all for it.

I would say that the UK probably thought he was attempting to get into UK without any ties, travel around a bit, and get back into Poland... ya know just 'float around'. I can't say from the OP's description of it, what he had traveled to the UK for. If had been a short stop to then continue onwards to a US destination, they should have surely returned him to his home country. Or it could very much be one of those cases that get very screwed up in a time when the HO isn't particularly friendly to a potential immigrant of any kind.

OP: The issue is really going to be what address will he use on the application? Who will be picking up and reading the important mail from the USCIS that he must obtain? What job has he got in the US that allows him so much time away from his country to be with you? Does he meet the financial guidelines? What will be the living and job situation in the US? This is not a quick application you know. It may take up to 6 months to process, and a few more to complete on top of that.

We're very aware of the journey ahead of us. All requirements will be met, that's not the issue. He has family there, ALL of his family is there. They will handle the information until he returns.

You're right about London, he took the time to write the situation out as it happened. The Border Agent was pretty rude to him at first, then regretted it once she saw he was very kind the whole time. They ended up saying he was intending to enter and leave the next morning back to Poland. It was a mistake that he wasn't informed much about. He also has a big beard and tattoos, they did ask him all kinds of crazy questions. Interesting story but yes you hit it on the head.

It can certainly happen going from Schengen to non-Schengen especially with an overstay in the Schengen.

OP, the only issue that might happen is exit controls when he flies back. I don't know how his flight will be routed or whatever, so this is variable. We usually exit the Schengen zone in Iceland and they are strict about the time limits Americans can spend in the zone, i.e. the 90 days. The penalties are a fine and possible ban from the region. We have been questions twice about our legal status in the area as my daughter only holds an American passport and would have overstayed if not under my EU family rights. This past time I tried to exit with my American rather than British passport and had to produce the British one because they couldn't found out how long I had been in the region.

Just something to keep in mind.

It will not have any impact on your US immigration process.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Do you think being a USC gives us a free pass to enter any European country? Sorry to say England has their own laws, and they don't care about us being American. Americans are denied entry all the time, whether they enter via Europe, or they enter directly from America. I'm shocked they did not send the OP's fiancé back on the next flight to America, but he got lucky there.
