I am the petitioner for my husband. We received a Request for Initial Evidence. I forgot to include my w-2's when sending out the i-864 so first request was to include the supporting tax documentation.. which is fine.

This is my first full year with my new career so my 2015 tax return does not reflect what I make currently.. so I made sure to include a letter from my employer.

Now the second request was saying I do not meet the requirements for my household size.. it is only my husband and I. I got a letter from my employer stating my hours and wage.. I only included my paystubs from my last three months. I do meet the requirement for my household size with an estimate of $30,000 for this year.

I was not able to retrieve my paystubs for the start of this year because they switched pay companies mid year and blocked me out of my account.. so my year to date that I earned does not reflect on what I've made this whole year so far..

I really don't want to get a joint sponsor if I don't have to.. and I don't really have assets to prove other than finding a way to get my employer to get my paystubs from the beginning of this year..

What should I do??? Did they say I don't meet the requirements because I didn't provide enough evidence with less paystubs to look at?

Or should I just bite the bullet and find a joint sponsor? We are doing this without a lawyer so I don't want to mess this opportunity up. Thanks !!!

Even thought it says it's your current income that matters, in many instances they will not approve someone even with an income well over the poverty line if they can't show they've been consistently hitting it (ex. steady employment for three years). I would recommend getting a joint sponsor straight away.

Your other option would be to send in paystubs from the whole year (if you can get them) and if worse comes to worst and they deny you again, maybe they will allow you to bring joint sponsor documents to the interview. However, that also means you would have much less time to secure that joint sponsor - so, if possible, the best option is still to find a joint sponsor immediately.

Also, depending when your husband's interview is, he can bring your 2016 tax returns with him to the interview (if you've had enough time to file them, of course) and ask that the joint sponsor be removed from your account as you now can prove your stable income. That's what I plan to do for my husband's interview.

I would send a transcript from 2015, a letter explaining that you make enough and how and try to somehow get the missing pay

stubs and send them also. Ask HR or supervisor on how to get a copy of the previous pay stubs.

Include a cover letter with all items you send.

They always say you don't meet the income for your household even though you do, you just need to send enough to prove it.
