Misrepresentation on f1 visa

A few years ago I came to the states and worked illegally with my tourist visa. Months later I applied for an f1 visa and it was granted. However, now I am applying for adjustment of status since I married a us citizen and I will say the truth about everything. Something that worries me is the fact that when I applied for my f1 visa I answered no the question "have you ever overstayed or violated the terms of a us visa?" And now that I'm filling out the forms I am reporting that I worked before getting my f1 visa under a tourist status. I am willing to face the consequences of my actions but what happens if they don't ask me about it even if report it? Will that be some sort of forgiveness? Or do I have to verbally "confess it" even if it is written on the forms?

The problem is not working illegally, that'd be forgiven.

The problem is the misrepresentation when you got the F-1, the same question was most likely asked you that time and you lied then (otherwise you would not have gotten the F-1).

That's a big problem. I'd consult a lawyer on this one.

Doesn't matter. The question would have been asked on the visa application form you filled out.

Yeah, you're right. My question here I guess is, if I tell the truth on the new application and they approve it, Willa that mean that they overlooked my new application or that they forgave it?

That is hard to say because the only reason you got the F-1 was you said "No" as to not violating any previous visa rules or US law.

So now you are doing AOS through marriage while being on the F-1 and now admitting to violating the terms of the tourist visa....

It could go either way. They could forgive the illegal work on the tourist visa, or they may deny you AOS and hold you accountable for it.

I have to second the consulting a lawyer about this to check your options.

It's entirely possible that lying on the f1 application makes your visa void and your student eligibility could be scrutinized. Consequences of misrepresentation could come back to bite you. Just sayin..

I totally agree with KierenHby, you have to be honest in terms with immigration. I suggest you hire an attorney to help you with your case.

I guess you need a lawyer to file a waiver.

if you keep lying on the forms it will only make things worse when they do find out. and file back taxes since that can at least show you are trying to do things legally now

Good advice, especially on filing back taxes. You really don't want to be an enemy of both USCIS and the IRS.

Update: I talked to my attorney today and she said that I do have to file a waiver, which I will do. Thanks a lot for your help and encourage me to do the right thing!

I don't think you can file a waiver right now. First you have to be told that you need to file one by USCIS.

My attorney said I can submit the waiver along with the GC application since I am admitting to have misrepresented myself
