Vacation Question on K1/AOS Visa - Just looking for confirmation!

Hello

Just looking for some confirmation, even though I think I unfortunately already know the answer.

My Fiance's family want to take us on a cruise to the Bahamas once I move over there towards the end of next year. I'm just wondering if there is any way to do this?

When I come in to the states and use the K1, I know it is only good for one use, so I assume that if I depart from Miami and go to the Bahamas on this cruise - then getting back in would be an issue as the K1 is no longer valid. Adjusting my status, I know I have to wait for my AP before I can leave... so does that mean I wouldn't be able to go on this vacation?

As I said I think I already know the answer, I just wasn't sure if I'd maybe missed something that would allow me to do so :)

Yes you should not go on the vacation unless you have your EAD/AP in hand prior to departure

OP, please fill in your timeline so that we know where in the process you are. As said above you would not be able to go on this vacation if you do not have AP (Advanced Parole). It takes 60-90 days to get advanced parole once you are married. Where are you in the process?

You are correct, you can't leave until you have either the AP or Greencard.

If the vacay is end of next year it is quite possible to have it in time. It all depends on how far along in the process you are now.

Hi All,

Thank you for your responses!

We're submitting next month, so I know it's difficult to predict until we've actually started the process. I just wanted to know if there was any other way around it - but that's OK we will hold off on the vacation until i have my EAD/AP card. The vacation will take place at the end of August, start of September. I'm hoping to move over there in July (visa permitting obviously!), and we weren't going to marry until the first week in August!

Once I've submitted I will make sure my timeline is kept up to date!

Is getting married and getting a spousal visa an option for you?

Would be cheaper and you could start working and traveling right away. If you hace a straight forward case it would take roughly a year or so.

We decided to go down the K1 visa option, as it looked like the fastest option to get me there. We've been doing long distance for a year now, with 3-5 month waits in between, so we're just kind of over the extreme periods of time apart now. We're planning on getting married in New York where my fiance lives, it's not too much of a problem the not being able to travel aspect - we can go on a vacation once I've received my EAD/AP card, plenty of places to explore in the states for the mean time! I just wanted to double check to see if I had missed a loop hole or anything haha! Thank you for all your advice !
