Hi all. Im getting married to my US Citizen Fiance this week and we are going to start the process of AOS this month. I found a guide on this forum but it states it is for K1 Visas, im really sorry for opening a new thread, but can anyone please provide me with a link or guide to the AOS process for an F1 Student. I'm currently in the US, in Status and on OPT.

I had three quick questions.

Do I need to get a medical done?

Can I still work on my OPT once I file for AOS? Im going to apply for the new EAD in the meantime, but I was not sure if filing made this one obsolete.

When filling out the forms, should I use my new family name or old one?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Kindly read the forum on Concurrent filing through Spouse, U will have to file I-130, I-485, I-785 and I-131. and yes I-693 (medical) and I-864(affidavit of financial support) both have to be filed.

You can keep working on your OPT till you get your new card, once you get your new card you would have to update your work authorization status with your employer on I-9 form.

If you are the beneficiary, i would recommend you to keep your new name because that would be printed on EAD and GC. (Till the point you attach marriage cerficate whenever required, it should be good.

Other senior members correct me if i am wrong.

Thanks for the reply! so must i file medical with the first packet with the I-130, I-485, I-785?? My field office has like a year wait for an interview according to forums. I was under the impression I could do the medical right before the interview so it doesnt expire?

Can someone confirm with me that I should use my new name on the I-485 and all other forms ( new name after marriage).

1) I am not sending the Medical in with the original packet and will bring it to the interview, this is ok too?

2) On I-765 it is asking "what am i applying for"? I am currently on OPT so do i say permission to accept employment or renewal of permission to accept employment with my old EAD copy?

3) Some addresses on the forms will not fit if I type them in, is it OK to print them out and fill in the blocks in black ink using pen with the ones that cannot fit in.

Yes, use your married name.

1) it's fine.

2) permission to accept employment, code C 9, do not send a copy of your EAD

Hi guys

One more question. We are sending everything on monday but my husband works as an airline pilot and is paid hourly. His expected income is between 30,000-35,000 but for employment verification they only gave us the base pay ( not including hourly gaurentee) which equals $21,741.53. Our household size is only two so this exceeds the $20,025 limit, but barely. Im worried this may cause some issues or is it ok?

2) permission to accept employment, code C 9, do not send a copy of your EAD

Are you sure about this, I was under the impression that when you are changing status from F1 to LPR, we do have to send all our old EAD documents also.

I do understand it is totally a new application under a new status but i think you still have to send any other EAD documents that have been issued to you by the USCIS earlier in any other status
