I am a Canadian who was offered a job in New York recently. I have a 1 year Certificate in New Media Design & Web Development and 8 years of experience in web design + front-end development. The company hired a lawyer who helped me with my application for the Graphic Design TN Visa. After the application was done, he realized I only had 1 year of schooling when the TN visa required 2 years of post-secondary.

I tried crossing the border with my application anyway hoping it would be something they'd look over considering the lawyer missed it (dumb on my part). The border officer was very nice and seemed like he wanted to help but rules are rules and he was just doing his job. He withdrew my application and assured me that this wouldn't affect future TN applications nor would it affect me entering the states as a visitor.

Long story short, I've lost my job offer but am still desperately trying to figure out other options since I know I could get another job offer easily. I have thought of trying including the Management Consulting TN, or incorporating myself as a business in Canada and contracting for a company until I can apply for a H1B Visa.

Any advice would be great. Also, if I were to go back to school, would it count as 2 years of post-secondary if I just took another 1 year program? Does accumulating 2 years of education count or do I have to take 2 full years in 1 program? Thanks!
