I'm confused on several different things in regard to the Affidavit of Support. On some websites, it says my alien fiance needs to have a completed form I-864 from me, and on some it says a form I-134. Which one is correct?

I'm also unsure if child support counts towards income/earnings for the purpose of this Affidavit. Some sites say it doesn't because it's purpose is not income but to be for the children. Other sites say it can be used. Which one is right?

Do I need to attach proof of all of my assets an income as well, or is the signed form all that is required?

Just to clarify, we have filed the K1 Visa petition, we received our NOA's and are now at the point where he's gathering his police report, vaccination records, Affidavit of Support and other documents for his portion of the Visa process. Thank you!

you will need both at different times

the i134 is for the k1 visa to enter the country. that affidavit of support is non binding and will expire

after you get married and file the adjustment of status, you will need to file the i864 affidavit of support

Talk directly to an attorney. I can't stress this enough. There are different procedures in different countries. My fiancé and I were given a 221g because the receptionist at my attorneys office told me we didn't need a tax return or other proof of income at the interview. Later, my attorney was furious. Turns out the receptionists fiancé came from Mexico and that IS standard there but not in Japan. We are now looking at a 3 day-2 year wait and might have to start this whole process over with an I-129f because of bad advice! Write down any questions you might have, pay $100 for a consultation, and also see how much the adjustment of status will cost. It's worth it!!!

For a fiancee visa you will need to submit the I-134.

I don't know about alimony as income but if you can show that you have enough income to meet the minimum requirements for a fiancee visa, you don't need it anyway. Same thing goes for assets. If your income is enough, you do not need to itemize and submit any proof of assets you have.

The minimum income requirements change slightly once you are married in the US and are applying for AOS.

3 years worth of W2s, a few months worth of paychecks and maybe an official letter of employment showing income and time in service should be enough.

You don't need an attorney for this; I had one for the initial stages and later found out that all the information she provided could have come from this website.

The rules are the same, and are applied equally, no matter what country the fiancee is from.

2016-09-03 Received I-797 approval notices for EAD/AP in the mail


2016-09-06 Received EAD/AP combo card


2016-09-22 Interviewed Sep. 22, Green card not approved due to missing paperwork


2016-09-26 Submitted missing documentation


2016-09-28 Received text messages for I-485 "new card ordered" and "case was approved"


​2016-09-29 Went o local office to have passport stamped with I-551


2016-10-05 Green card arrived via Priority Mail (105 days)
