So we got our RFE hard copy today.. they asked me to semd them the divorce documents signed by a judge.. i have the papers tbey need what worries me now is my divorce is done by sharia court.. does that going to affect our application? Is anyone here has the same case as we do?? Hope to hear from you guys..

I have not looked at your earlier posts (if any).

Are you the petitioner or the beneficiary?

I you are the filipina, is the divorce recognized in the Philippines?

If yes, go over to the Philippines sub forum and see if there are any issues with this.

If not, then you need a civil divorce.

If it is common, I cannot believe there is an issue.

Sharia divorce is not excepted in immigration proceedings someone put up a thread recently on this let me look

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

My understanding of the new rule: If you were married under Sharia law and divorced under Sharia law, your divorce will be honored by the U.S. Embassy Manila. If you were not married under Sharia law, your Sharia divorce will not be honored.

For those who were not married under Sharia law, but who were divorced under Sharia law, it appears to complicate things because the civil registrar and the PSA documents will show that you are divorced. So, where does an annulment fit into the picture? How can you get an annulment if you are already divorced?

Well i heard and read some cases which is same as i do and yes sharia divorce is recognized in philippine law.. infact i have with me my annotated yellow paper from PSA..

That was the case in the past but now in the last couple months the Philippine embassy has started cracking down on it supposedly because of the Philippine government behast. Your fiance would have to have been married by sharia court and divorced by sharia court. Someone already posted that previous topic of the poster being denied because she got divorced by sharia court.
