What will happen after 10 year ban is over ?

Hi everybody,

I am a green cardholder since 2008 and live in America. My daughter was deported in 2006 and she could not visit me for 10 years. Now the time is over and I wonder if she will face problems at the embassy in Frankfurt for her visa to come here for a visit. Does anybody has similar experience ? Thanks.

She will not get a tourist visa or a non immigrant visa

Why ' because she already showed she over stayed and would do it again - basically she did not follow the visa rules the first time why would she now?

She needs a k1 or cr1 visa - or any visa with immigrant intent

K-1 is non-immigrant visa.

So it's really a lifetime ban then really if someone doesn't want to marry a us citizen......

Would it be the same if they applied for an investment visa promising to bring jobs etc?

Seems harsh but I guess those are the rules so families stay split. You probably have to go visit her overseas then instead.

K-1 is non-immigrant visa.

With immigrant intent as the poster stated.

EB2 (Investment) Visa requires a minimum of $500k, HOWEVER, it doesn't erase the deportation.

There are two ways an immigrant that overstays can leave the US, voluntarily or involuntarily. If your daughter was deported by immigration then, yes, it has sever consequences. Basically it means that not only did she not follow the rules of immigration, but it required officials and other resources to action to remove her from the country. Otherwise she would still be ignoring the laws and staying here. Now do you see why it would be difficult for her to receive any other visas in the future.

If the 10 years are up she can spend the money and try and see what happens.

no t enough information, why was ashe deported, does she have a stable life in Germany, family, good job lots of ties.

yes, seems like lifetime ban as my friend was here with student visa and studying at college with family (wife and 1 son, another born here)

because of problems with his family, he had to quit college and wanted to AOS and stay

they said NO and deported and he had a 3 year ban

even though he is a police man and wife a teacher in his own country and they own a house, his wife was recently denied tourist visa (leaving husband and both sons in brazil) she wanted to come to US, visit family and get a copy of sons Birth certificate, and renew his passport

they had told her before they could apply after the ban (which was long over)

OP, you could naturalize. Germany has a process of preserving German citizenship, but it has to be done BEFORE applying for US citizenship.

Once a USC, you could file a petition for your daughter. If she is unmarried, it's 7 years' wait for PD to become current. If she is married, about 12 years' wait. Once her PD becomes current, she could get her immigrant visa, once she enters the US on it, she'll get her GC.

If she has no plans to live in the US, this still may be her best chance. Once she has the GC she can give it back and apply for a tourist visa instead. This usually convinces the Consulate that she does not want to live in the US if she gives up her GC.

Thanks for all your answers. My daughter was overstaying her visa in 2005 und we both were deported in 2006. I could return through the hardship 601after 18 month. My daughter had to wait 10 years. Why a ban of 10 years , if its still difficult to return after the punishment? She has established her life in Germany. She has a german fiancée , good job, my son and his family is in Germany as well ... so no attention so move to the us. She only likes to visit in Spring to be with her sister when she graduates from Highschool. If I understand you all right this visit will be impossible , she will not get a visa. We know she cannot get in on the visa waiver. She went to the embassy after 3 years , at this time she found out that she can't entry for 10 years. Thanks to all of you for your help. Lilikoi

The process I outlined above about her receiving a GC through you after you naturalize may be her only chance. Like I said, relinquishing a GC usually convinces the Consulate that she does not want to live in the US. This way she could get a tourist visa at the end.

As for the spring visit, she can apply for a tourist visa. All she has to lose is the application fee.

It is not impossible for her to get a tourist visa, but it is unlikely, especially so shortly after her ban is up.

If she has $165 to spare to apply for a tourist visa, I say go for it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

K-1 is non-immigrant visa.

It said any immigration visa or visa with immigration intent. A K-1 has immigration intent, therefore a visa that she would be eligible for.
