Priority date and tourist visa question (split)

Hi,

I am posting on this thread because currently I am on the middle of process to bring my spouse here in USA.

I am a Green card holder and did petition I-130 on Dec31 2015. That is my priority date.

The case was approved on June 2016. And transferred to NVC.

After 1 month I received an email from NVC stating that, 'However, your case is not currently eligible for further processing because there is an annual limit on the number of immigrant visas that the Department of State can issue' ....

It's almost 5 month and I didn't see any updates on Visa bulletin and didn't got any information from NVC. I send an email to NVC about what is the expected date. They responded as, It's unpredictable!

What you guys suggest on this? Do you guys have an idea, usually how long does it take? Would it be better, If I go ahead and Try a tourist visa for my Spouse?

You have a bit of a wait still. The Visa bulletin does move; the December one states they are working on February 2015, so another 10 months or so until it will be your turn, but it could slow down or speed up: https://travel.state.gov/content/visas/en/law-and-policy/bulletin/2017/visa-bulletin-for-december-2016.html

You can try for a tourist visa so your spouse can visit, but they cannot live or work here with it and would need to return after a few months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you for you response.

I haven't receive a date for Filling up Immigrant Visa Form (DS-260) and Affidavit Of Support form (I-864). If I try for a tourist visa for my wife, Is it going to cause any conflict on this existing process?

No conflict, but her chances of getting a tourist visa are quite slim, as she has a pending immigration visa case.

Still, it only costs $165 to apply and even if denied, it will not affect the spousal visa, so worth a try if you have the money.
