USCIS SENT OUR PACKAGE BACK!!

My husband's conditional green card expires on 02/03/17, USCIS received the package on 11/02/16 and sent it back stating that we filed in advance of the 90 days. Seriously... 1 day prior to the 90 days. You would think they would consider, but no.

They sent the package back to us and we got it yesterday. So now we will be sending it back. This is so stupid. OMG how frustrating. You would think they would appreciate an early submission, but I guess not.

Sooooo... Our forms are signed on 10/26/16, would this make a difference? Or does it really just depend on when all the forms are received? Should we reprint a new form with new dates or is the original 10/26/16 fine??

There was a notice attached to our documents stating to resubmit, but nothing about the dates. We don't know what to do.

PLEASE HELP ASAP. We will be sending first thing in the morning.

Hi ItsmeKit, to make you feel better, I had exactly same situation like yours (1 day early) and USCIS send it back my package. Just re-send them and I will suggest you to print new form with current dates.

It's better that they send it back now rather than the package intake team thinking "eh, it's only a day early", then when it reaches an adjudicator months later they deny it for early filing date. They have to do everything by the book as much as possible or there will be no clearly defined process.

It's a minor setback. You haven't been denied and they most likely didn't cash your check. Print the new forms, sign with current date and send right back

Hopefully it'll all be smooth sailing from this point on.

Seriously, if they accept 1 day early from anyone, then someone trys 2 days early and before you know it, the process gets out of hand and everyone trys to file too early

they have rules for a reason

we all have to follow them

OP was more than 1 day early. Knowing that 90 days is not the same thing as 3 months, and how to calculate it, is part of the solution.

Exactly. Earliest accepted filing date was 11/05/2016. It was 3 days early. Edited November 12, 2016 by EM_Vandaveer
