AOS from K-1, Need Help.

My wife and I are an LGBT couple in the middle of AOS from a K-1. After the election results we're really quite scared.

My AOS says online " Case is ready to be scheduled for an interview" as of Oct 5th. We already got an AP and Employment Authorization Card.

How long does an AOS from K-1 take to be scheduled? We're in California and didn't have an RFE. Is there any place I can call to get status on that Interview date?

It seems unlikely that Trump will be able to change rules fast enough to prevent her from getting the Conditional Green Card. However the condition of the GC will be our marriage. What happens if our marriage is no longer recognized? Is there another avenue for her to stay/work/immigrate here without leaving the country? She's currently in Grad school and leaving isn't an option.

I would appreciate your thoughts.

Yes, you're right. I was being too hopeful.

So another question is - Say the rules change while we're in the middle of the process. Do we immediately get rejected?

ex post facto laws are prohibited under our constitution. if your marriage is valid under the recent same sex marriage laws, trump, his congress and the SC can not make it illegal, that which was legal before.

besides, laws do not take effect until after they have been published for a year.

we are in the same boat, btw.

There's nothing going to happen to your greencard or petition because Trump won presidency. He is against illegal undocumented immigrants, not legal immigrant who are doing it the right way!

There's nothing going to happen to your greencard or petition because Trump won presidency. He is against illegal undocumented immigrants, not legal immigrant who are doing it the right way!

He is anti gay and his VP just verified he's anti gay. If the federal government stops recognizing gay marriage as actual marriages then one has no legal way to apply for immigration things conditional of federal recognition.

Hi we are a same sex couple too. According to my fiancé its part of a federal law so we don't need to worry about anything as long as we did it in a legal way.

I really don't think he's going to ban any LGTB right. I can get people are scared but do realize a lot of gay people voted for this man, too.

Legal immigrant will be fine. He wants to lower the H1B visa for workers because he wants the Americans on the jobs first.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
