Hi folks!

It has been a long time since I posted on the site, but I read posts nearly every day. Anyhoo...I received a letter from USCIS reminding me that as a conditional resident I must file a I-751 and send in proof of entering marriage in good faith, etc. Well, (and I shouldn't be surprised by this), they say that I entered the US as conditional resident on 2/17/15. I had barely gotten back from Montreal, and did not even receive my passport (CR1 stamp) in Winnipeg until 2/20/15. My actual POE date was 4/18/15.

My question is how do I correct them? Do I even have to? I thought that the date on my greencard was the date I need to go by. I don't even know how they came up with February 17. I did not enter the US after my interview until the day I moved, which was April 18, 2015.

Any insight on this would be helpful. I am tempted to ignore the letter date and go with the one on my greencard but if their date for me is wrong...what else could be wrong?

Almost the same happened with me. I received a reminder letter for my ROC by mail. It had the wrong date of entry to the US, different from the one on my GC. The letter said I entered in the January 7 but I actually entered in January 17th, that's what my GC says too. I didn't care much about it and I didn't notify them. I personally don't think it really matters.

The immigration process caused me PTSD.

I agree with you, but there is nearly two months difference between their date and mine. I plan on filine the day after my window opens. I just don't want them to say I am late or anything because they are wrong. :)

Check the date on your actual visa. We got our reminder based on the Visa date, not date of POE.

I think it might be worth a call to USCIS to clarify with them. Ask for a Tier 2 agent who can actually look into your case file (you might need to opt for a call back).

My reminder notice was based on my POE which was 11/24, which is the same date printed on my Green Card.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Interesting. I checked again and mine was based on the issue date in the Visa.

I would. I mean when you send in the package you'll be sending a copy of your Green Card which shows the residency start date, but if they have it in their system you entered on a totally different date and it would make you "late" in their system when you do file, you should make sure they correct their records.

I agree that you need to fix this so that you're not filing late. Obviously the CBP wrote down the date of your entry wrong (by writing down the date your visa was issued.) You may want to make an infopass to correct this.

If you get it away before they would consider it late then you're fine.

Thank you NikLR. Since my actual POE was actually 59 days after they think I crossed, I would agree with you. Could you please remind me how to go about the infopass? I have never needed to do this before.

My husband had a similar thing happen... got a letter reminding him to remove conditions with a date for becoming a permanent resident as the day he interviewed for the visa. That was more than two months before he entered the US, so the date they said he could file was more than two months early. That was back in August, I posted on VJ, and the advice I received was that it isn't necessary to contact them and that it's the date on the card that matters, which in our case correctly represents his POE. I hope that was good advice, because we are still getting ready to file and coming up to the two year anniversary of the date they indicated in the letter... I am guessing that someone who is in charge of sending out letters is not knowledgeable about the significance of different dates throughout the process.

OP, if you do make an infopass to correct the date, would you please let us know whether they say it's important?

I don't think CPB wrote the date down wrong, unless it's wrong ON the card itself.
