My story goes dis way i am married to USC last year December 2015 and she filled I130 for me inJanuary 2016 but in July our case was denied by USCIS simply because the photo of our wedding has 2013 on it although it WAS my fault bcos i didnt set the Camara date appropriately. however, i applied for F1 visa to study which i have the visa approved but in my DS160 i didn't put my wife name and address bcos i knew if i did that i might get denied . now am scared about the PORT OF ENTRY BY DHS. would my denied i130 have significant effect on my F1 at the port of entry? i need a candid advice folks . pls no insult

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What DID you put on the form? Did you claim to be single? If so yes, that will be a problem.

i put MARRIED on the form but it was not my wife name. would dat be a problem at the port of entry? i just want to go to school nothing more

Did you file for the F1 student visa after being denied the spousal visa?

If you got the F1 before the spousal visa, it probably got cancelled when the spousal visa was denied.

You lied and made a material misrepresentation, now you deal with the consequences of your lies.

If you "just want to go to school nothing more," then you shouldn't have lied about your USC spouse.

So your F1 when we're you approved?

It could be an issue. Nit sure seems timing is really off here.

Give us the timeline.

But if you are approved it might be am issue because at the POE they will see your I-130.

No the timing of your F1 is suspect.

Suuuuuuuuureeee.... You were denied the spouse visa and instead of re-applying you thought: "Hey, I can cheat the system. I will use this student visa to go the USA, meet up with my wife (who I didn't mention on the paperwork, oops!) and adjust my status."

This smells like a fraud. We can see it, Immigration will see it. You can absolutely have troubles.

I am not familiar with the details of the DS160; if there is a space for the spouses name, and you put a wrong name, you lied, and yes it could be considered material miss-rep, as she is a USC, and that can lead to a lifetime ban from any visas. If you simply put "married", and there is no space for the details, and they never asked then you should be fine.

Isn't there also a space for listing any relatives you have in the USA though? If there is, and you didn;t mention your USC wife, again that is a big problem.

On the DS-160 you must declare any relatives in the USA. It's the same form that is used for tourists.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I guess I'm confused why aren't you fixing the I-130 error and resubmitting?

You didn't answer my question. I would quest you applied for the F1 before you filed the I-130?

I am also thinking your denial wasn't about a time stamp but about the date you said you were married on your F1 and who you said ypu were married to on your application which you would have got before you filed the I-130 correct?

If that's the case don't be surprised if it's already cancelled now that you have shown you want to immigrate.

Do seek an attorney you need one.

We are trying to find out what exactly you did, how much you lied, to offer the best solution.

The best thing to do, based on what we know so far, is for yout o contact the embassy and tell them you didn't put your wife's details on the form, and that she is a USC. If you tell them, as opposed to them finding out at the border or later when you )presumably?) try to AOS, there is a chance they will not call it material missrep, and may even ammend the F1 and still allow you to use it. It is a small chance, but the only chance to stay legal.

The form specifically asks for name and location data about immediate relatives in the US and states that spouse is an immediate relative . It also specifically asks for data about your spouse including place of birth. If you answered either of these with bad data specifically to further the chances of your student visa getting approved you are subject to a bar. Furthermore a routine check of your name should have pulled up the I 130 filed for you so I assume you used a "second" passport with a different ID that is common in Nigeria. Both of these will get rightfully get you banned for life.

This will not be over quickly. You will not enjoy this.
