My wife is here on a K-1 fiance.

I have learned that she married me and is planning secretly with her family in the Phil to go back to the Phil after our 30 day marriage is sealed (when its final).

she is planning on taking our baby back with her.

i signed the birth certificate in the Phil, but have not done anything here yet to claim paternity in the USA.

Can i stop her from taking my baby?

Need a little more clarification.

What does the, "30 day marriage" have to do with anything?

Has she filed for Adjustment of Status? If not and she leaves, then her status in the US will be abandoned and she will not be able to legally return to the US without you filing a spouse petition for her.

Why is she secretly planning with her parents? Does she want out of the marriage?

Does she know that you know? If so, then you need to have a serious talk with her about the future of your child.

As a father you have a right to be able to see your child but it sounds like she is not happy. We are only hearing your side of the story and even your side of it is not thorough.

You should be searching for an EXCELLENT family lawyers, like yesterday.

Exactly what plan?? She gets nothing, she will not get a green card or anything based on your details. She is willing to let all go, the full K1 time etc, clearly either she just said something of the cuff after a fight or things are bad!

Are you sure of that plan? It doesn't really make sense, she would not get a greencard or anything this way. Perhaps she just had a bad day, sleeplessness due to baby and said something silly to her family?

Ooooppsss.. I missed that part of getting the issue sorted in which they should very soon. I am just telling him what he could do for the time being coz chances are he will wake up one morning finding out that his wife and baby are gone. I was just paying attention on the part that his wife has been planning secretly with her family in the Philippines to go back home after the marriage is sealed. Yes, babies need their mummies but what if the mum could not provide for the baby? I'd say the baby will have a better future in the US given that he/she is raised the right way unless the mum is well off in the Philippines and could give that future. But in the end, I still wish they could settle this matter and raise the baby together and have a happy family life.

I'm sorry to hear about your situation. I'd say hide their passports, well at least the baby's.

He can not hide her passport. It's hers. He would be stealing it from her, not hiding, according to the law.

His child's passport is something he can hide.

Sounds like question was written fast for answers from a man wno is upset and just didn't explain all things

and to all

she may have thought along with her family she could come and marry, go back and ask for money to support her and the baby

this may have been planned out in her country when the family found out she was pregnant

family may be more upset as you impregnanted her when she was not married to u

register the birth if you need to here in US

i doubt you do as there is a US passport

and see an attorney

many here have already said a wife can not take a child out of a state without permission of the father

how can she take it out of the country?

where is she getting money to buy the tickets?

let her know there is no way she can force you to send money to her if she leaves and ask her to see a counselor
