K-1 Visa: can I put it on hold to obtain permission to relocate for my child

Hi,

I would like to know if it is possible to start application for K1 and then go to court to deal with mobility case for my son (it can easily take over a year, exact timing is unknown). And then finish visa application and K 2 for my son and do the rest to enter US and get married. The problem is that mobility case in court needs some proof of commitment and starting application could be that but since timing of mobility process is unknown, be pressured by dedlines to enter US does not fit me. I badly need advise. Fiance is not ready to go through marriage first...
