All right fellow Nebraska hell hole....I broke down and called USCIS. After getting a very pleasant tier 1 person, who pretty much looked at the same website as I do and read off what it said. So, I requested an escalation to a tier 2 officer.

Got a call back and basically she was trying to read off what I got in the inquiry of the out of date status. Yes, Nebraska is back logged and is taking a longer time frame....No duh. 

So the magic words, can you tell if someone is ACTIVELY looking at our case? I was put on hold for a good 5 minutes, I'm sure for dramatic effects. She came back and no, your application has not been assigned to anyone.

WTH?? We are talking 300 days now!!!! What am I to do???

Well apparently call back or make another inquiry in 30 days......:huh::huh:

Oh God will this ever end???? Hang in there... Keep records of all you do. Every time you call and inquire and every time what is said to u...if you submit on line inquiry keep accurate records. Next step congressman and senators.. you have to exhaust all means necessary then contact this place I will give u...

Yes in the original inquiry they said background check. I think this was to give an illusion that someone had actually looked at our paperwork. Apparently nobody has sadly enough.

This just does not make sense. They do background checks when they start your file. How can they do background check when they have not even assigned your file to any officer. One of their statement is definitely incorrect. I think you should ask again if it has been assigned to an officer or not. Its a nightmare.

Sadly enough, there used to be a time where they didn't do background checks until you are ready for your interview AFTER the NVC. I think because of the changes with the immigration laws and change of commander in chief has a lot to do with the hold up. I-130 was just what it says it is, an application to have your spouse approved to submit an immigration application. Evidence was to show they QUALIFIED to do it.

Thank you everyone for your good luck and prayers. The interview was super long 2.5 hours. The officer asked very detailed questions. I just feel he is acting like he's asking questions to criminals. It's horrible. We are now waiting for review. I don't know some questions are like what kind of diamond ring is my engagement ring. It is "brilliant" on the document but come on I don't even know. Do you know what kind of diamond ring your ring is? All I know it's from Tiffany. He was very offensive at one point during the interview.

Are you serious? 2. 5 hrs? Are you in China and that's where interview held?? I feel you passed interview. Seems like they just try and make you uncomfortable. How long does review take? I know you are nervous still waiting for the outcome but relax if u can as I feel you passed. I feel it in my gut....

Yes 2.5 hours. I'm not in china. My spouse and I are both here in the US. I guess you know my husband is in removal proceedings so therefore the officer is strict. Also I'm like 25 and my husband is 29 and we usually get people thinking that we look like high school/college students so the officer may think our marriage is not bona fide at first glance. We also actually got called 30 minutes before our actual appointment time too. My lawyer came at 8:45 and we were already inside interviewing. They were actually not allowed to do that I think. Later when my attorney came in, he seems to have a slight change in attitude meaning a bit better. Also it's weird how the officer lets me translate for my husband. On the paper it says we have to wait about 84 days. My lawyer said it's usually not that long. I hope we hear back soon. Sigh...

Good lawyer arrived as yes ones demeanor changes when a lawyer is inside. I wish you well while still on your journey. Keep me posted. I will keep u in prayer and pls say prayer for me as I'm still in the waiting stage to hear a NOA2 from uscis. Keeping seperated from my husband like this is very painful...

So when you say your husband is in removal

proceedings, what does that mean? He had overstayed his visa permit and is now trying to change his status? Completely understandable now why you had an interview. I guess I was under the assumption that he was out of the country and you are trying to bring him here. Well at least you have had some kind of movement of your application. Me and my husband, we are waiting with me here in the USA and him in Spain. I know the delay is because he is in the process of getting his Spanish citizenship and originally from Pakistan. What a mess.
