Hi all VJ members,

Unfortunately, I committed a crime by using a fake document at the embassy. So, I have a life time ban and I have my court day soon because of this fake document. I am not sure but what my lawyer says it is going to be a suspended jail time probably which means I will be on probation for 5 years. This 5 years probation will not affect my life at all it's like a second chance that government give you. I will be able to travel. I would like to know if I have to wait until my 5 years probation is over or not to submit my waiver.

Please advise. Thanks.

You're light on relevant details.

I am already inadmissible for fraud/misrepresentation and I need a waiver for this. As far as I know, if you committed a crime and sentenced more than 1 year it's another inadmissibility. If the out come of the court would be suspended jail time which is 5 years probation in my country, do I have to wait 5 years to file a waiver or not to go back to US? Is there a chance that they will tell me to wait until the probation is over to file a waiver?

Timeline

Your punishment from your local court and your inadmissibility are separate. Until you have a cause to have a waiver filed you can't file one. You are banned for life. Under what situation do you have a case to file a waiver ? The approval of a waiver for presenting false documents to the embassy is rare.

This will not be over quickly. You will not enjoy this.

Your punishment from your local court and your inadmissibility are separate. Until you have a cause to have a waiver filed you can't file one. You are banned for life. Under what situation do you have a case to file a waiver ? The approval of a waiver for presenting false documents to the embassy is rare.

My wife is a US Citizen and our I-130 application is being processed. Probably, my visa will get denied at the interview and than will file I-601 and we have to prove extreme hardship in order to get approved.

Why would you show fake documents when you are married to a USC? You squandered your best chance at immigration.

The embsssy will advise you if you are eligible for a waiver at your interview. Once that is determined you can proceed with the waiver filing. It is separate from your court case.

Okay, so in some prior attempt at a US visa, you showed fake documents. Then you miraculously found a USC to marry. Is that right?

Thank you and I know it is separate from my court case but isn't committing a crime another inadmissibility if the sentence is more than a year?

Yes, unfortunately I showed a fake document. I met my wife about 2 years ago when I was there. I lived there for 5+ years. So, it's not that I found my wife miraculously after this happened.
