He talking about b1/b2 visa.. anyone Enters US on tourist visa and try to adjust status has to go through to this rule.. what i have hears 60-90 days are safe to marry.. don't get marry right away because that will be considered fraud..

Not true

I am sharing my own experince because i was about to adjust status when i was in the US. This is why i know about this rule because i have personally met an attorney.. i was not ready to adjust so i choose CR1.. andbi would still suggest to hire an attorney on b1/b2 cases..

Your attorney was wrong. It is not an enforced rule. You can search on this site many people who got married on B2 visas without relying on that rule.

Doesn't matter for you now because the attorney got your money.

Yes sir! There is no enforced rule or anything written on books.. but attorney are the best source to rely on in such cases.. again domt rely on me.. but i have consulted two attorney on that one in Iowa and one in Illinois and both pretty much had same answers.. so all i m suggestung to consult and attorney on tourist visa cases.. ita not a rule but just to be on safer side this rule is followed..

Yes my attorney does have money this is why he took care of my CR1 case..

It's not the getting married that's the issue. I got married on the VWP within 100 hours of landing. I was only staying a week. No intentions of adjusting (as should be the case for everyone) and didn't adjust. Getting married as soon as you arrive on a visit is not a problem. The problem is if you posed as a tourist at CBP but secretly had every intention of marrying AND adjusting. It doesn't matter whether you get married the day after you arrive or on day 85 of an 86-day stay. It's not illegal to get married (assuming you are free to marry).

I would never recommend telling CBP you are visiting a "friend" when you are planning to get married. Why the secrecy? It's not a crime to get married. They keep the address that you write on your blue customs slip on file. I discovered this when my husband (then-boyfriend) moved and on my next visit I wrote the new address, told the CBP officer I was visiting my boyfriend and the very next question was "well what happened to the boyfriend at xxxxx address? Last time you were here you gave that address." I pointed out that it was the same boyfriend but he had moved. I was told that he would call him to verify this if he wanted to but he didn't actually do that.

You are absolutely correct JFH.. thank you!! right when i came over i was there to attend my wife cousin wedding..my attroney said if i wanted to go with CR1 i can get married anytime i want and file for i130 and leave but if i decide to adjust my status its safe to marry after 60 days after my arrival so it seems legit..

From personal experience, I got married 16 days after arriving into the country and just had my case approved. Wasn't even questioned about it. Never lied to the CBP officer but also didn't volunteer information about my boyfriend. The key here is being honest with CO, CBP and USCIS.

When I came in to get married I said I was visiting my fiancé and left it at that. Sometimes I wish I'd stayed and adjusted but we had some financial stuff to take care of that took about the same length as the CR-1 anyway...

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Most attorneys will say whatever they need to for you to give them money. Instead of you doing a simple adjustment of status he made the case sound more complicated and dangerous than it was and cost you lots more money. Which meant more money for him.
