Can somebody please let me know the criteria where Family should fall into First preference to migrate into the US?

You are correct. You can file for your child at anytime but the waiting time for them to get the visa will vary. Also, green card holders cannot file for a married son/daughter, only US citizens can.

My husband got naturalised as a citizen recently and wants to sponsor his brother for Permanent Residency. The wait time for sibling is about 10-12 years. My husband's nephew is now a little over 4 years. So given the wait time; we were trying to understand if our nephew needs to be under 18 or under 21 to be brought in as a permanent resident.

The wait for people getting sibling visas today has been 13 years or so. People that apply today should expect much longer waits as siblings are the most impacted class. A good estimate with the current laws would be closer to 20 years for most countries.

Most countries don't permit sponsoring of siblings at all so the us is actually more lenient than most even though it is a long wait.
