Well, lately, they "seem" to be processing F2A petitions a lot faster of late, so perhaps if they continue this trend, it could be anywhere from 3-5 months below the above estimated time frame. The current "c" status is for those who are applicable to file AOS or already have approved petitions waiting for NVC/Counselor processing.

How do we know they are processing faster ? according to online resources it has always taken California 1.6 to 2 years. Currently they are processing between Jan 2018 to July 2017. Seems to be like the pace is the same ( I would be very very very happy if anyone could prove me wrong )

Well, perhaps you may be correct. My case took approximately 19.63 months before my status changed to "Initial Review", then I got an RFE in exactly 19.66 months (pretty much 6 days after they started working on my case). Therefore, in this sense, the case processing time has indeed taken the estimated time frame they always publish as "19 Months to 24.5 Months". I suppose since I was expecting my case to start adjudicating sometimes in October/November and later learned they started in July, I was under the impression they started earlier. In essence, I was expecting adjudication , at the 23 months time frame -- the long end of the estimation time span, but they started at the beginning of it -- not exactly, as you say, early since 19 months in of itself is a hell of a long time to wait.

I have to agree...you have approximately between June 2020 to July 2020 before they start working on your case (if they continue with the 19-24.4 months for F2A processing times).

I terms of how you should execute and respond to your RFE, I truly am in the dark on how best you should proceed. The reason why I say this is because they seem to be having serious doubts on the claimed relationship and getting an RFE is already a strike again us in getting an approval, you don't want to mess this part up by inadvertently sending insufficient supporting documents (as counterproductive as that may seem relative to a DNA test).

 

Honestly, I suspect because of your country of petition (Middle East), they are placing exceedingly higher and (seemingly) unfair burden of proof on you (and probably others from this part of the world). (The politics of it is well established). In summary, I would highly recommend that you see a reputable immigration attorney because of the complex nature of your RFE.

 

Hi, i am stuck, need your advice , i posted my situation in other threads but no one seemed giving me a clear answer,   its about the DNA test. so how the DNA test works is that the petitioner which in this case is my father needs to initiate the process  in US all he needs to do is visit a AABB accredited facility , that specific facility will send the DNA collection kit to the beneficiary where the beneficiary lives  to the embassy of that  country ( which in this case the beneficiary are me and my other siblings ) the problem is i don't want to waste any more time , the question is can i and my other sibling do a DNA test here in Dubai on a tourist visa , because we are living here on a tourist visa , or do we need to go back to home country and do the Test there. because i want the DNA test to be done soon so going back to home country would delay the test.

Well don’t want to dash your hopes but currently approval is just the beginning of your wait.

 I’m also in F2a category PD January 2017, and I have scaled the NVC stage and gotten my case complete letter in February 2019 but no interview date has been set 5 months later. I noticed this is peculiar to F2a category at the moment. Even with the case complete no interview date has been scheduled for several months. The waiting game continues and NVC refuse to give a reason. All they will say is your case has been documentarily qualified and that an interview will be scheduled be patient. 5 months later..... still waiting.

Wow. That is really weird. Normally the long wait is either at noa2 or after the interview.

and also we are looking for a good lawyer but that may take some days,

If you are currently within the US on visitor/tourist visa, then of course you can go on and perform the tests there at a accredit AABB facility. The tests do not care where they were done, once all the primary parties were involved in the testing process and done at a recognized facility, the USCIS doesn't care where you were when it was done. If your blood, your father's and your siblings blood doesn't change regardless of where each of you are on planet. So go ahead and take advantage that you are currently in the US on a tourist visa where you have access and the convenience of your father (and siblings) to do the test all at the same facility. This will certainly speed up the process significantly. Please make sure to also find and include secondary evidence that the RFE requested just to cover all your bases when you are ready to submit the DNA test results.

Thank you so much dear thats what i wanted to hear , that means i can do DNA test along with my sibling if we are living in another country on a tourist visa..
